APPLICANT REQUESTS THAT:

In the applicant’s request for reconsideration  for  award  of  the  Purple
Heart Medal (PH) he submits written testimony from an eyewitness,  who  saw
him immediately after the attack.

STATEMENT OF FACTS:

The applicant served on active duty in the Air Force from  21 January  1970
to 18 January 1974, as a Security Policeman.  His DD Form 214 reflected  he
was awarded the National Defense  Service  Medal  (NDSM),  Vietnam  Service
Medal (VSM) and Air Force Good Conduct Medal (AFGCM).

The applicant submitted an appeal to the Air Force Board for Correction  of
Military Records (AFBCMR) on 2 July 2003 requesting award of the  PH.   The
applicant's request was considered and denied by the  Board  on  3 November
2003.  For an accounting of the facts  and  circumstances  surrounding  the
applicant's eligibility for receiving the  requested  decoration,  and  the
rationale of  the  earlier  decision  by  the  Board,  see  the  Record  of
Proceedings at Exhibit G.

The  applicant  submitted  an  undated  DD  Form  149,  with   attachments,
requesting reconsideration  for  award  of  the  PH,  based  on  eyewitness
testimony (Exhibit H).

THE BOARD CONCLUDES THAT:

Sufficient  relevant  evidence  has  been  presented  to  demonstrate   the
existence of an error or injustice to warrant awarding  the  applicant  the
PH.  After  reviewing  the  documentation  submitted,  the  Board  majority
believes the applicant has provided sufficient evidence to support award of
the PH.  In this respect,  the  majority  notes  the  letters  from  fellow
servicemembers who attest to the fact the applicant was injured as a result
of enemy action and that he received medical treatment  for  the  injuries.
In view of the circumstances  of  this  case,  and  the  limited  personnel
records, the Board majority believes any doubt in  this  matter  should  be
resolved in the favor of the  applicant.   Therefore,  the  Board  majority
recommends he be awarded the PH.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air  Force  relating
to the APPLICANT be corrected to show that he was awarded the  Purple  Heart
(PH) for injuries sustained  as  a  direct  result  of  enemy  action  while
serving at DaNang Air Base, Vietnam on 4 March 1971.

MEMORANDUM FOR THE CHIEF OF STAFF

      Having reviewed and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116) it is directed that:

      The pertinent military records of the Department of the Air Force
relating to                 , be corrected to show that he was awarded the
Purple Heart for injuries sustained as a direct result of enemy action
while serving at DaNang Air Base, Vietnam on 4 March 1971.
