ADDENDUM TO
RECORD OF PROCEEDINGS
AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS
IN THE MATTER OF: DOCKET NUMBER: BC-2003-02317
COUNSEL: Dept of Vet Affairs
HEARING DESIRED: No
_________________________________________________________________
APPLICANT REQUESTS THAT:
In the applicant’s request for reconsideration for award of the Purple
Heart Medal (PH) he submits written testimony from an eyewitness, who saw
him immediately after the attack.
_________________________________________________________________
STATEMENT OF FACTS:
The applicant served on active duty in the Air Force from 21 January 1970
to 18 January 1974, as a Security Policeman. His DD Form 214 reflected he
was awarded the National Defense Service Medal (NDSM), Vietnam Service
Medal (VSM) and Air Force Good Conduct Medal (AFGCM).
The applicant submitted an appeal to the Air Force Board for Correction of
Military Records (AFBCMR) on 2 July 2003 requesting award of the PH. The
applicant's request was considered and denied by the Board on 3 November
2003. For an accounting of the facts and circumstances surrounding the
applicant's eligibility for receiving the requested decoration, and the
rationale of the earlier decision by the Board, see the Record of
Proceedings at Exhibit G.
The applicant submitted an undated DD Form 149, with attachments,
requesting reconsideration for award of the PH, based on eyewitness
testimony (Exhibit H).
_________________________________________________________________
THE BOARD CONCLUDES THAT:
Sufficient relevant evidence has been presented to demonstrate the
existence of an error or injustice to warrant awarding the applicant the
PH. After reviewing the documentation submitted, the Board majority
believes the applicant has provided sufficient evidence to support award of
the PH. In this respect, the majority notes the letters from fellow
servicemembers who attest to the fact the applicant was injured as a result
of enemy action and that he received medical treatment for the injuries.
In view of the circumstances of this case, and the limited personnel
records, the Board majority believes any doubt in this matter should be
resolved in the favor of the applicant. Therefore, the Board majority
recommends he be awarded the PH.
_________________________________________________________________
THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating
to the APPLICANT be corrected to show that he was awarded the Purple Heart
(PH) for injuries sustained as a direct result of enemy action while
serving at DaNang Air Base, Vietnam on 4 March 1971.

The applicant submitted a request for award of the PH to the Purple Heart Review Board (PHRB). He is requesting this award because he was wounded on 4 March 1971 as the result of direct enemy action. Exhibit B.
AF | BCMR | CY2005 | BC-2005-00731
On 27 March 1984, the HQ USAF Purple Heart Review Board reviewed the applicant’s request for the PH, and found the documentation submitted did not fully substantiate the award because there were no statements from eyewitnesses regarding the incident, nor any documentation that clearly proved the injuries received were a result of direct enemy action. DPPRS concludes the applicant has not provided any additional documentation with his second request (Exhibit C). In addition, the applicant...

DPPPR states the applicant submitted a request to the Purple Heart Review Board on 25 August 2005. DPPPR states to be awarded the PH, a member must provide a detailed personal account, eyewitness statements, and medical documentation to show the wound(s) received treatment by medical personnel and occurred as a direct result of enemy action. In addition, the applicant did not provide supporting documentation from eyewitnesses or testimony from other former members of his unit who were with...

While there is medical documentation pertaining to an injury received; there is no evidence in the record concerning enemy action. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that the applicant has not been the victim of an error or injustice. While there is medical documentation...

However, should the applicant provide the above information or testimony from other former members of his unit who were...
