APPLICANT REQUESTS THAT:

He be awarded the Republic of Vietnam Gallantry Cross with Palm.

Five Bronze Stars be reinstated on his Vietnam Service Medal.

Resume of Case:

On 23 Oct 01, the Board considered and denied the  applicant’s  request
for award of the Armed Forces Expeditionary Medal and the  Republic  of
Vietnam Gallantry Cross with Palm (Exhibit  E).   AFPC/DPPPR  noted  in
their evaluation that the applicant was not entitled  to  any  campaign
credit on his Vietnam  Service  Medal  and  corrected  the  applicant’s
records to so reflect (Exhibit C).  They also advised the applicant  in
separate correspondence of their findings and recommendations regarding
his requests (Exhibit F).  He was advised to provide a copy  of  orders
assigning or attaching him to a unit in Vietnam, which would  make  him
eligible for the requested decorations.  The applicant did not  respond
to AFPC/DPPPR.

In a letter dated 22 Jan 04, the applicant again requests award of  the
Republic of Vietnam Gallantry Cross with Palm and reinstatement of  the
five Bronze Stars on his Vietnam Service Medal (Exhibit G).

THE BOARD CONCLUDES THAT:

After reviewing the new evidence submitted by the applicant, the  Board
does not find sufficient evidence that the applicant  was  assigned  or
attached to a unit in Vietnam, which would entitle him to the medals he
seeks.  It appears that the applicant is confused over  the  difference
between being assigned or attached to a unit vice being in a  temporary
duty (TDY) status.  The favorable  communications  that  the  applicant
provides as proof of his assignment to a unit in Vietnam  clearly  show
that the applicant was assigned to a unit  at  March  AFB,  California.
Based on this fact, we do not find a basis to  recommend  awarding  the
medals requested.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did   not
demonstrate the existence of probable material error or injustice; that
the application was denied without a personal appearance; and that  the
application will only be reconsidered  upon  the  submission  of  newly
discovered relevant evidence not considered with this application.
