APPLICANT REQUESTS THAT:

She be paid the Selective Reenlistment Bonus (SRB) for career field 5J0X1
effective 12 June 2001.

APPLICANT CONTENDS THAT:

According to her Enlistment/Reenlistment contract and career  field,  she
is entitled to an SRB.  She enlisted in the Air  Force  Paralegal  career
field, 5J0X1, in June 2001 and was made aware of the fact  that  she  was
entitled to a bonus since she reentered the Paralegal career field.

In  support  of   her   application,   she   provided   copies   of   her
enlistment/reenlistment  contract,  assignment   orders,   statement   of
service, and e-mail messages concerning  SRB  Listing.   The  applicant’s
complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:

On 24 February 1988, the applicant enlisted in the Regular Air  Force  at
the age of 20 in the grade of airman basic for a  period  of  six  years.
She was progressively promoted  to  the  rank  of  staff  sergeant  (E-5)
effective and with a date of rank of 1 April 1995.  She served as a Fuels
Journeyman, Air Force Specialty Code (AFSC) 2F051, for five years  and  8
months and then as a Paralegal Apprentice, AFSC 5J031, for 2  years.   On
23 January 1996, the applicant was honorably discharged to enlist in  the
Air National Guard.  On 31 July 1998, she was honorably  discharged  from
the Air National Guard for expiration of her term of service.  On 12 June
2001, the applicant enlisted into the Regular Air Force in the  grade  of
staff sergeant (E-5) for a period of four years.  Due  to  her  break  in
service, her date of rank was adjusted to 12 June 2001.  The applicant is
currently still on active duty  with  a  Total  Active  Federal  Military
Service Date of 12 Febraury 1993.

AIR FORCE EVALUATION:

AFPC/DPPAE recommends the  applicant’s  request  be  disapproved.   DPPAE
states that at the time the applicant reenlisted, there was not a program
in place that allowed her to receive an SRB.  AFI 36-2606 paragraph 2.5.3
states that prior service personnel may receive an SRB if  they  reenlist
within  three  months  after  discharge  or  release  from  active  duty.
However, in order for this to happen, there must be a  program  in  place
that allows for the bonus.  There has not been a program in  place  since
1990 that allows prior service members to reenlist and receive  a  bonus.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

Copies of the Air Force Evaluations were forwarded to the applicant on  9
Aug 02, for review and comment within 30 days.  As  of  this  date,  this
office has received no response.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was timely filed.

3.  Insufficient relevant evidence has been  presented  to  demonstrate  the
existence of an error or injustice.  Evidence has not been provided  showing
that the applicant should have received an SRB based on  her  12  June  2001
prior service enlistment.  According to the  Air  Force  office  of  primary
responsibility, there was no SRB  program  in  place  that  allowed  her  to
receive an SRB when she  enlisted.   In  the  absence  of  evidence  to  the
contrary, we agree with the opinion and  recommendation  of  the  Air  Force
office of primary responsibility and adopt their rationale as the basis  for
our conclusion that the applicant has not been the victim  of  an  error  or
injustice.   Accordingly,  the  applicant’s   request   is   not   favorably
considered.
