APPLICANT REQUESTS THAT:

In the applicant’s request for reconsideration, he  requests  award  of  the
Purple Heart (PH) medal for injuries sustained during action  on  8  January
1951 in support of the Korean War.

STATEMENT OF FACTS:

The applicant’s combat record reflects that he had 55 night intruder  combat
missions, 257 combat hours (B-26), Korea (Jun 50 to Oct 51). He was  awarded
the Korean Service Medal (KSM) by General Orders No. 130, dated 29  Mar  51.
The applicant was relieved from active duty on 30 Jun 63,  assigned  to  the
Retired Reserve Section and placed on the USAF Reserve Retired List  in  the
grade of major on 1 Jul 63.  He had completed a total of 20 years, 4  months
and 10 days of active service for retirement.

A similar appeal was considered and denied by the Board  on  13 March  2001.
A summary of the evidence considered by the Board and the rationale for  its
decision is set forth in the Record of Proceedings at Exhibit F.

The  applicant  submitted  additional  evidence  through  his  Senator   for
reconsideration of his application.  To support this request, the  applicant
provided a personal statement  of  the  accident  and  additional  documents
associated with the  issues  cited  in  his  contentions.   The  applicant’s
complete submission, with attachments, is at Exhibit G.

THE BOARD CONCLUDES THAT:

After again reviewing this application and the evidence provided in  support
of the appeal, we are persuaded that some doubt has been created as  to  the
cause of the applicant’s injuries.  It  is  clear  that,  at  the  time  the
accident occurred, the applicant’s aircraft was in  hostile  territory.   In
view of the applicant’s statement and the additional evidence submitted,  we
agree it is possible the aircraft  accident  that  led  to  the  applicant’s
injuries could have been caused by enemy fire.  Having no  reason  to  doubt
the applicant’s credibility, we believe he has met the burden of  proof  and
any doubt should be resolved in  his  favor.   In  view  of  the  foregoing,
equity dictates that his request be favorably considered.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air  Force  relating
to APPLICANT be corrected to show that he was awarded the Purple  Heart  for
injuries he received in action against an enemy of the United States in a C-
46 aircraft during a mission over Chungju, Korea, on 8 January 1951.

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:

      The pertinent military records of the Department of the Air Force
relating to APPLICANT be corrected to show that he was awarded the Purple
Heart for injuries he received in action against an enemy of the United
States in a C-46 aircraft during a mission over Chungju, Korea, on 8
January 1951.
