APPLICANT REQUESTS THAT:
In the applicant’s request for reconsideration, he requests that the grade
of Sergeant be reinstated.

STATEMENT OF FACTS:
The applicant was honorably discharged on 7 December 1945, in the grade of
private. His WD AGO Form 53-55, Enlisted Record and Report of Separation,
reflects his highest grade held as Sgt. At the time of his separation, he
was credited with 3 years, 10 months and 22 days of active service for pay.
The applicant’s request that the grade of sergeant be reinstated was
considered and denied by the Board on 3 August 2000 (see Exhibit B).
Through his member of Congress, the applicant submitted a request for
reconsideration and provided additional documentation in the form of a
Notice of Change of Address, two photos, a certificate of military service
for the period 19 Sep 40 thru 18 Sep 41, and a copy of his WD AGO Form 53-
55, Honorable Discharge, effective 7 Dec 1945 (Exhibit C).

THE BOARD CONCLUDES THAT:
The Board previously considered the applicant’s request and noted that his
military records were not available. Therefore, based upon the presumption
of regularity in the conduct of governmental affairs, his request that the
grade of sergeant be reinstated was denied. We have reviewed the
additional evidence and it appears that at some point in time during the
applicant’s career in the Air Force he was a sergeant. However, the same
documentation reflects that the applicant was discharged in the grade of
private. Based on the foregoing, we again find insufficient evidence has
been presented to show that the applicant’s rank at the time of his
separation was in error. However, should he submit additional evidence or
provide a detailed statement surrounding the reason for his demotion, we
would be willing to reconsider his request.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.
