APPLICANT REQUESTS THAT:
He be reimbursed for overpayment of Servicemember’s Group Life Insurance
(SGLI) premiums he paid for the period of 1 Apr 97 through 1 Nov 99.

APPLICANT CONTENDS THAT:
On 20 Mar 97, he elected to reduce his SGLI coverage from $200,000 to
$50,000. After several months, he noticed that his coverage had not
decreased. He went back and forth between Finance and the Military
Personnel Flight (MPF) until approximately 3 Nov 99, in an effort to
resolve the problem.
In support of his request, applicant provided a personal statement. His
complete submission is at Exhibit A.

STATEMENT OF FACTS:
Data extracted from the personnel data system reflects applicant contracted
his initial enlistment in the Regular Air Force on 13 Dec 95. He is
currently serving on his second enlistment which he entered on 14 Apr 99,
in the grade of senior airman, having assumed that grade effective and with
a date of rank of 13 Dec 98.
Documents provided by AFPC and the applicant indicate that on 20 Mar 97,
applicant signed an SGLV Form 8286, Servicemembers’ Group Life Insurance
Election and Certificate, electing SGLI coverage in the amount of $50,000.
Deductions for coverage in the amount of $200,000 continued to be taken
from his pay until approximately November 1999.

AIR FORCE EVALUATION:
The Director, Personnel Accountability, AFPC/DPW, reviewed applicant’s
request and states that additional evidence was requested from the member
to sufficiently evaluate his claim. Although applicant responded and
provided more information, he failed to provide copies of his leave and
earnings statements from 1 Apr 97 to present. Due to the lack of
sufficient evidence provided by the applicant, denial is recommended (see
Exhibit B).

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
In further support of his request, applicant provided a copy of his SGLV
Form 8286 (see Exhibit D).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of probable error or injustice. Documents provided indicate that
on 20 Mar 97, the applicant completed the appropriate paperwork electing
SGLI coverage in the amount of $50,000. However, it appears that the
proper premium was not being deducted from his military pay until December
1999. We are convinced by the evidence provided that he made every
reasonable effort to ensure the proper monthly premiums were being deducted
from his pay, however, due to reasons beyond his control he was unable to
do so. Accordingly, we recommend his records be corrected as indicated
below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating
to APPLICANT be corrected to show that on 20 March 1997 he elected coverage
under the Servicemember's Group Life Insurance (SGLI) program in the amount
of $50,000.

MEMORANDUM FOR THE CHIEF OF STAFF
Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that on 20 March 1997 he
elected coverage under the Servicemember's Group Life Insurance (SGLI)
program in the amount of $50,000.

The applicant's request to be reimbursed for his SGLI premiums was considered and denied by the Board on 15 April 2003. Lackland AFB notified its servicemembers of the pending change to SGLI coverage by using the base bulletins, newspapers, and the April 2001 pay statements. It would appear that he was notified of the SGLI increase and we find no evidence to support his miscounseling contention.
