APPLICANT REQUESTS THAT:
He be reimbursed the Servicemembers’ Group Life Insurance (SGLI)
premiums deducted from his pay in Jun 01 and Jul 01.

APPLICANT CONTENDS THAT:
Prior to leaving the United States, his SGLI was stopped at Langley
Air Force Base (AFB).
In support of his appeal, the applicant provided a personal statement
and copies of his SGLI documentation and his leave and earning
statements (LES).

STATEMENT OF FACTS:
Applicant was relieved from active duty on 31 Aug 01 and retired,
effective 1 Sep 01, in the grade of technical sergeant. He was
credited with 20 years and 18 days of active duty service.
By SGLV Form 8286, the applicant declined SGLI coverage on 13 Jun 01.
His LES indicated that premiums were deducted from his pay in Jul 01
and Aug 01.

AIR FORCE EVALUATION:
AFPC/DPW recommended that the Board approve the applicant’s request
for refund of SGLI premiums for Jul 01 and Aug 01 totaling $40.00 and
disapprove his refund for Jun 01. According to DPW, his election on
13 Jun 01 did not become effective until 1 Jul 01.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to applicant on 12
Oct 01 for review and response. As of this date, no response has been
received by this office (Exhibit C).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of probable error or injustice. Having carefully reviewed
this application, we agree with AFPC/DPW that corrective action is
warranted in this case. The evidence of record reveals that the
applicant declined SGLI coverage on 13 Jun 01. Thus, he should not
have had premiums deducted from his pay in Jul 01 and Aug 01 and is
entitled to reimbursement of the deducted amount. Since the
applicant’s declination was not effective until 1 Jul 01, he is not
entitled to reimbursement of the premium deducted from his pay in Jun
01, as he has requested. In view of the above, we recommend that the
applicant’s records be corrected as indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that on 13 Jun 01, he
declined Servicemembers’ Group Life Insurance (SGLI) coverage.

Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the authority
of Section 1552, Title 10, United States Code (70A Stat 116), it is
directed that:
The pertinent military records of the Department of the Air
Force relating to , be corrected to show that on 13 Jun 01, he
declined Servicemembers’ Group Life Insurance (SGLI) coverage.

The applicant's request to be reimbursed for his SGLI premiums was considered and denied by the Board on 15 April 2003. Lackland AFB notified its servicemembers of the pending change to SGLI coverage by using the base bulletins, newspapers, and the April 2001 pay statements. It would appear that he was notified of the SGLI increase and we find no evidence to support his miscounseling contention.
