The reasons the applicant believes the records to be in error or
unjust and the evidence submitted in support of the appeal are at
Exhibit A.

STATEMENT OF FACTS:
Reports by the Air Force Office of Special Investigations (AFOSI) are
retained for 15 years; therefore, other than the documents contained
in the applicant’s military personnel records, no further information
regarding his homosexual activity is available.
The available relevant facts pertaining to this application are
contained in the applicant's military records (Exhibit B) and in the
letter prepared by the appropriate office of the Air Force (Exhibit
C). Accordingly, there is no need to recite these facts in this
Record of Proceedings.

AIR FORCE EVALUATION:
The Military Personnel Management Specialist, HQ AFPC/DPPRS, reviewed
the appeal and provides his rationale for recommending that the
applicant’s discharge be upgraded to general, but not honorable.
A complete copy of the Air Force evaluation is at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A complete copy of the evaluation was forwarded to the applicant on 17
Nov 00 for review and comment within 30 days. As of this date, this
office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Sufficient relevant evidence has been presented to demonstrate
the existence of probable error or injustice to warrant partial
relief. Under current Department of Defense and Air Force guidelines,
the applicant would have received an honorable or general discharge
since his records do not indicate he attempted, solicited, or
committed a homosexual act by using force, coercion, or intimidation.
However, in view of his overall record, which includes evidence of
receiving an Article 15 on two occasions, we believe a general, rather
than honorable, characterization of service is appropriate. Therefore,
we agree with the Air Force’s suggested partial relief and recommend
the applicant's records be corrected to the extent indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that, on 30 March 1967, he
was discharged with service characterized as general (under honorable
conditions).

MEMORANDUM FOR THE CHIEF OF STAFF
Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the authority
of Section 1552, Title 10, United States Code (70A Stat 116), it is
directed that:
The pertinent military records of the Department of the Air
Force relating to APPLICANT, be corrected to show that, on 30 March
1967, he was discharged with service characterized as general (under
honorable conditions.

She has been married to an active duty Air Force member for 23 years and supported his entire career (Exhibit A). The board recommended that the applicant be discharged because of unfitness with a general discharge. Applicant’s grade at time of discharge was airman (Amn/E-2). The pertinent facts surrounding his discharge are contained in the Air Discharge Review Board (AFDRB) Hearing Record at Exhibit C. ___________________________________________________________________ AIR FORCE EVALUATION: HQ AFPC/DPPRS reviewed this application and addressed the reason for the discharge. They considered the length of time since discharge, the reason for the discharge, and the applicant’s otherwise honorable service. If there had been a properly updated selection record showing him as a graduate of in-residence SSS, that record would have had sufficient time to be scored or re-scored by the board. Applicant's Officer Selection Brief (OSB) did not reflect his completion of Senior Service School (SSS) at the time he was considered for promotion by the CY00A selection board.
