APPLICANT REQUESTS THAT:
His DD Form 214 (Certificate of Release or Discharge From Active Duty)
be corrected to reflect award of the Sixth Oak Leaf Cluster (6OLC) to
the Air Force Commendation Medal (AFCM) instead of 5OLCs, the Joint
Service Commendation Medal (JSCM), and the Kuwait Liberation Campaign
Medal (KLCM).

APPLICANT CONTENDS THAT:
Due to the error in OLC sequence of his AFCMs and the nonrecorded JSCM
and KLCM, points toward his military promotion may have been affected.
If he was eligible for other decorations, such as the Presidential
Unit Citation, he is unaware and requests this be checked. He states
that if there is the chance that correcting his records will show that
he should have been promoted between 1991 and 1993 (his retirement
year), he would be grateful.

STATEMENT OF FACTS:
The relevant facts pertaining to this application, extracted from the
applicant’s military records, are contained in the letters prepared by
the appropriate offices of the Air Force. Accordingly, there is no
need to recite these facts in this Record of Proceedings.

AIR FORCE EVALUATION:
The Chief, Recognition Programs Branch, AFPC/DPPPR, reviewed this
application and indicated that applicant’s entitlement to 6OLCs to the
AFCM and both the KLCM (Saudi Arabia) and KLCM (Kuwait) has been
verified and his DD Form 214 has been corrected to reflect these
changes. However, there is no indication in applicant’s records that
he was recommended for, or awarded, the JSCM. On 22 Jul 99, he was
asked to provide a copy of the orders awarding him this decoration but
he did not respond to the request. Without a copy of the orders for
award of the JSCM, DPPPR cannot verify applicant’s eligibility for, or
entitlement to, this decoration and recommends disapproval of his
request to add the JSCM to his DD Form 214.

attached at Exhibit C.
The Chief, Inquiries/AFBCMR Section, AFPC/DPPPWB, also reviewed this
application and indicated that the last promotion cycle the applicant
was eligible for consideration to the grade of technical sergeant
prior to his retirement date was 93A6 with promotions effective 1 Aug
92 – 1 Jul 93. His total score was 317.99 and the cutoff score
required for selection in his Air Force specialty code (AFSC) was
332.53. Contrary to his belief, neither the Presidential Unit
Citation (if eligible) nor the Kuwait Liberation Campaign Medal are
used for promotion points under the Weighted Airman Promotion System
(WAPS). Consequently, whether they were awarded or not, had no impact
on his promotion consideration to technical sergeant.
DPPPWB further states that policies regarding the approval of a
decoration and the credit of a decoration for promotion purposes are
two separate and distinct policies. Current Air Force promotion
policy (AFI 36-2502, Table 2.2, Rule 5, Note 2), the directive in
effect at the time, dictates that, before a decoration is credited for
a specific promotion cycle, the close out date of the decoration must
be on or before the promotion eligibility cutoff date (PECD), and the
date of the DECOR-6, Request for Decoration Printout (RDP) must be
before the date of selections for the cycle in question. Each
promotion cycle has an established PECD which is used to determine
what AFSC or Chief Enlisted Manager (CEM) Code the member will be
considered as well as which performance reports and decorations will
be used in the promotion consideration. The PECD for the cycle in
question, 93A6, was 31 Dec 91. In addition, a decoration a member
claims was lost, downgraded, etc., must be fully documented and
verified that it was placed into official channels prior to the
selection date.
The AFCM for the period 4 Jun 90 – 15 Jun 91 initially identified as
the 4th OLC but amended by permanent order G-215, 12 Jul 91, to
correct it to the 5th OLC, was not considered in the promotion process
for the 93A6 cycle. Promotion cycle 93A6 was the only cycle it was
eligible for consideration based on the closing date of 15 Jun 91. If
it had been considered, his total score would have increased by three
points, from 317.99 to 320.99, still 11.54 points below the 332.53
score required for selection. Assuming the applicant is credited with
the JSCM worth three promotion points, his total score would increase
another three points to 323.99, still 8.54 points below the cutoff
score required for selection in his AFSC.
The AFCM with 6OLCs for the period 29 Jul 91 – 1 Jul 93 was not
eligible for consideration in the promotion process. The closing date
was after the 31 Dec 91 PECD for the 93A6 cycle, the last cycle the
applicant was eligible for consideration before retirement. In
summary, a Presidential Unit Citation or the KLCM are not eligible for
consideration in the WAPS. In addition, if the applicant had been
considered with six additional points for the AFCM, 5th OLC, and a
JSCM, his total score for the 93A6 promotion cycle to technical
sergeant would still have been below the score required for selection.
DPPPWB recommends denial of promotion to technical sergeant based on
the rationale provided.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
Copies of the Air Force evaluations were forwarded to applicant on
7 Jan 00 for review and response. As of this date, no response has
been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Sufficient relevant evidence has been presented to demonstrate
the existence of probable error or injustice warranting favorable
action on the applicant’s request for award of the Joint Service
Commendation Medal (JSCM). After careful consideration of the
evidence provided, specifically, the citation and certificate
accompanying award of the JSCM, we are persuaded that the applicant
was awarded the JSCM. However, for whatever reason, it was not
entered in his records. Having no reason to question the documents
provided by the applicant, we believe any doubt should be resolved in
his favor and that his records should be corrected to the extent
indicated below. We further note that the applicant’s DD Form 214
(Certificate of Release or Discharge from Active Duty) has been
administratively corrected to reflect award of the Air Force
Commendation Medal (Sixth Oak Leaf Cluster), the Kuwait Liberation
Medal (Kuwait), and the Kuwait Liberation Medal (Saudi Arabia).
Therefore, no further action is required by this Board with respect to
these awards. After reviewing applicant’s record, to include the
above corrections, it appears that he still would not have been
promoted to the next higher grade.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that the DD Form 214,
Certificate of Release or Discharge from Active Duty, Item 13
(Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded
or Authorized), issued on 30 June 1993, be amended to include the
Joint Service Commendation Medal for the period 7 Aug 90 through 2 Mar
91.

Section 1552, Title 10, United States Code (70A Stat 116), it is directed
that:
The pertinent military records of the Department of the Air
