APPLICANT REQUESTS THAT:
His records be corrected to show that he was promoted to the grade of
technical sergeant during cycle 98E6, rather than cycle 00E6, with award of
the appropriate effective date and date of rank; and, he be permitted to
test for promotion to the grade of Master Sergeant during cycle 00E7.

APPLICANT CONTENDS THAT:
The computer generated decoration information close-out date of his Joint
Service Commendation Medal (JSCM) is 5 December 1997. This date is within
the cutoff requirement for the 98E6 promotion cycle and should be
considered during the promotion process. If added to his score, his score
would be above the cutoff for selection.

STATEMENT OF FACTS:
The applicant is currently serving in the Regular Air Force in the grade of
technical sergeant.
Promotion selections for cycle 98E6 were made on 20 May 1998 and announced
on 4 June 1998. The total weighted promotion score required for selection
in the applicant's Air Force Specialty Code (AFSC) was 357.10. The
applicant's total weighted promotion score was 355.52. The Promotion
Eligibility Cutoff Date (PECD) was 31 December 1997.
National Security Agency (NSA)/Central Security Service (CSS), General
Order xxxxx, dated 17 February 1999, awarded the applicant the JSCM for
outstanding achievement during the period of 30 September 1997 to 5
December 1997. The JSCM is worth three points in the computation of a
member’s total weighted promotion score.

AIR FORCE EVALUATION:
The Chief, Enlisted Promotion & Military Testing Branch, AFPC/DPPPWB,
reviewed the application and states that current Air Force promotion policy
(AFI 36-2502) dictates that before a decoration is credited for a specific
promotion cycle, the close out date of the DECOR 6, Recommendation For
Decoration Printout (RDP), must be before the date of selections for the
cycle in question. Furthermore, the PECD in question for his promotion
cycle was 31 Dec 97. There is no tangible evidence that the decoration was
initiated and placed into official channels prior to the date selections
for the 98E6 cycle were made. To approve the applicant’s request would not
be fair or equitable to many others in the same situation who also miss
promotion selection by a narrow margin. Applicant’s request to have the
decoration incorporated in the promotion process for cycle 98E6 as an
exception to policy was disapproved by the Promotion Management Section at
AFPC and they concur with this action.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
The applicant reviewed the evaluation and states that the JSCM was awarded
for merit and not for promotion purposes. When he volunteered for the
mission, he did not know that he would be missing promotion. He does not
believe AFPC is looking at this issue with an open mind and are using
outdated policy initiated back in February 1979.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of probable error or injustice. After thoroughly
reviewing the evidence of record and noting the applicant's contentions, we
are not persuaded that the JSCM should be considered in the promotion
process for cycle 98E6. In this respect, we note that since the decoration
was not submitted until after selections were made for cycle 98E6, the JSCM
does not meet the criteria for consideration during the cycle. The
statement from the commander is noted; however, there is no evidence that a
recommendation was placed in official channels prior to selections for
cycle 98E6. Therefore, in the absence of evidence to the contrary, we find
no compelling basis to recommend granting the relief sought in this
application.
4. The applicant's case is adequately documented and it has not been shown
that a personal appearance with or without counsel will materially add to
our understanding of the issue involved. Therefore, the request for a
hearing is not favorably considered.

The applicant be notified that the evidence presented did not demonstrate
the existence of probable material error or injustice; that the application
was denied without a personal appearance; and that the application will
only be reconsidered upon the submission of newly discovered relevant
evidence not considered with this application.
