MEMORANDUM OF CONSIDERATION OF APPLICATION BEFORE THE AFBCMR

SUBJECT:                ET AL

      Having carefully reviewed this application, we agree with the
recommendation of the Air Force office of primary responsibility
and adopt the rationale expressed as the basis for our decision
that the applicant has been the victim of either an error or an
injustice.  Therefore, under the authority delegated in AFI 36-
2603, the applicant's records will be corrected as set forth in the
accompanying Memorandum for the Chief of Staff signed by the
Executive Director of the Board or his designee.

MEMORANDUM FOR AFBCMR

SUBJECT: Application for Correction of Military Records -See
Attached Roster

This responds to your request for a BCMR advisories on members
formerly assigned to Anderson AFB, Guam, who PCS ' d before a
correction payment was made restoring a previous COLA reduction.

By way of background, The Per Diem, Travel, and Transportation
Allowances Committee (PDTATAC) reviewed cost reports submitted by
the command which resulted in a COLA reduction for Guam. Part of
the reduction was based on increases in CONUS prices not matched by
corresponding price increases in Guam. After careful review of COLA
rate setting procedures, the Per Diem Committee principals and USD
(Personnel and Readiness) decided that COLA should not be reduced
based on CONUS price growth. Accordingly, the principals voted to
restore COLA rates to the 31 May 99 level, effective 1 August 99,
and initiate a complete review of the COLA program. In addition,
the Committee principals and OSD approved restoration of the lower
COLA received during June and July.

There is no legal authority to change the COLA rate with a
retroactive effective date of 1 June. Therefore, PDTATAC sent rate
changes to all pay systems to pay a COLA dollar amount for 16-30
September 99 that will matched the amount of COLA missed during
June and July. Members received this one-time catch-up in their 30
September 99 pay. On 1 October 99, the COLA rates returned to their
previous level.

The above method repaid members still assigned to Guam, but did not
reimburse members who had already departed. These members were
advised to seek restitution through the Board for Correction to
Military Records.

Insight of this information, we recommend the Board approve these
requests. If the board decides to grant these requests, we suggest
the records be changed to reflect the COLA index for these members
was not reduced on I June 99. Specifically, we recommend their
records show the COLA index was 122 rather than 118 from I June 99
until their date of departure. Please see the attached roster for
specific information on each member (i.e. name, rank, SSN, number
dependents, and date departed Guam). Our point of contact for this

MEMORANDUM FOR THE CHIEF OF STAFF

      Under the authority of Section 1552, Title 10, United States
Code, and Air Force Instruction 36-2603, and having assured
compliance with the provisions of the above regulation, the
decision of the Air Force Board for Correction of Military Records
is announced, and it is directed that:

      The pertinent military records of the Department of the Air
Force relating to the nine (9) members whose names appear on the
attached listing be corrected to show that on 1 June 1999 their
cost of living allowance (COLA) index was not reduced from 122 to
118 and that the COLA index 122 remained in effect until their
departure from Anderson AFB, Guam.
