His Report of Separation be corrected to reflect award of the Good Conduct
Medal, and Asiatic-Pacific Campaign Medal.

The reasons the applicant believes the records to be in error or unjust and
the evidence submitted in support of the appeal are at Exhibit A.

STATEMENT OF FACTS:
The relevant facts pertaining to this application, extracted from the
applicant's military records, are contained in the letter prepared by the
appropriate office of the Air Force. Accordingly, there is no need to
recite these facts in this Record of Proceedings.

AIR FORCE EVALUATION:
The Recognition Programs Branch, Promotions, Evaluation & Recognition
Division, HA AFPC/DPPPRA, reviewed this application and states that the
applicant’s records have been corrected to reflect award of the World War
II Victory Medal, and the medal set has been mailed to him. Unfortunately,
he is not eligible for any of the other awards he requested. They
recommend disapproval of the applicant’s request for correction of his
Report of Separation to reflect award of the Good Conduct Medal, American
Campaign Medal, and Asiatic-Pacific Campaign Medal.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
Applicant reviewed the evaluation and states that his enlistment was for
three years. He completed all but seventeen days. The reason he served 2
years, 11 months and 13 days was because he had seventeen days of furlough
accrued. Rather than go home for the seventeen days and then have to
return to Virginia for discharge processing, he was discharged at that
time. No one informed him that he may have forfeited the Good Conduct
Metal by accepting a discharge seventeen days early.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest
of justice to excuse the failure to timely file.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of probable error or injustice warranting awarding the applicant
the Good Conduct Medal. After reviewing applicant’s overall record, we
believe that he should be awarded the Good Conduct Medal at the time of his
separation. In this regard, it appears that applicant served all but 17
days of his three-year enlistment. The reason for his early separation was
because he had 17 days of furlough time. In view of the fact that the
applicant was honorably discharged, and in recognition of the short period
of time involved (17 days), we believe that he should be awarded the Good
Conduct Medal. Therefore, we recommend the applicant's records be
corrected to the extent indicated below.
4. Insufficient relevant evidence has been presented to demonstrate the
existence of probable error or injustice warranting approval of his request
to be awarded the Asiatic-Pacific Campaign Medal. As noted by the Air
Force, the award in question was awarded for service during 7 December 1941
to 2 March 1946. Applicant’s records reflect that he did not enter the
service until 27 August 1946. Therefore, since he was not on active duty
during the period 7 December 1941 to 2 March 1946, he is not entitled to
the Asiatic-Pacific Campaign Medal. In view of our above determination, we
find no basis upon which to recommend favorable action on this portion of
his application.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating
to APPLICANT, be corrected to show that on 10 August 1949, as an exception
to policy, he was awarded the Good Conduct Medal for the period 27 August
1946 to 10 August 1949.

MEMORANDUM FOR THE CHIEF OF STAFF
Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:
The pertinent military records of the Department of the Air Force
relating to APPLICANT be corrected to show that on 10 August 1949, as an
exception to policy, he was awarded the Good Conduct Medal for the period
27 August 1946 to 10 August 1949.
