RESUME OF CASE:
In an application dated 5 February 1998, applicant requested
Special Selection Board (SSB) consideration for promotion by the
Calendar Year 1997C (CY97C) Central Lieutenant Colonel Selection
Board with the inclusion of the Meritorious Service Medal (MSM),
awarded for the period 15 July 1993 through 6 July 1995, in his
Officer Selection Record (OSR) .
On 23 July 1998, the Board considered and denied applicant's
request.
The Board concluded that there was insufficient
evidence of an error or an injustice warranting corrective
action. A complete copy of the Record of Proceedings is attached
at Exhibit E.
Applicant apparently e-mailed his rebuttal comments to the Board
in February 1998; however, at the time his case was considered by
the Board, the comments were not a part of the case file.
Applicant has now provided these comments and his case has been
reopened for reconsideration (Exhibit F).
THE BOARD CONCLUDES THAT:
Sufficient relevant evidence has been presented to demonstrate
the existence of probable error or injustice. It appears that as
a result of confusion caused by the closing of the USAF Combat
Rescue School, and personnel being reassigned to other
organizations, not everyone was submitted for an end of tour
decoration in a timely manner.
In the instant case, the USAF
Weapons School apparently attempted to remedy the situation after
applicant was assigned to it; however, the MSM was not finalized
in time for consideration by the CY97C board.
Clearly, the
service reflected in the MSM covered a time period well in
advance of the CY97C board and we believe it should have been
reflected in his record when he was considered by the CY97C
board. While it cannot be conclusively determined whether or not
the absence of the MSM was the sole reason for applicant's
nonselection for promotion by the board in question, we do
believe that it served to deprive him of fair and equitable
consideration. Therefore, we recommend his corrected record be
considered by Special Selection Board for the CY97C board.
AFBCMR 98-00420
THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, to include the Meritorious Service Medal,
awarded for the period 15 July 1993 through 6 July 1995, be
considered for promotion to the grade of lieutenant colonel by a
Special Selection Board for the Calendar Year 1997C Central
Lieutenant Colonel Board.

Executive Session on 22 October 1998, under the provisions of AFI

DPPPA stated that both the Education/Training Report (TR) and MSM, 1OLC, were filed in the applicant’s Officer Selection Record (OSR) and considered by the P0597C central lieutenant colonel selection board. After careful consideration of the applicant‘s complete submission, we believe some doubt exists as to whether...
Had he properly reviewed his OPB at that time, he could have written a letter to the CY97C board president to ensure the information was present for the CY97C board's review - especially if the PME entry was important to his promotion consideration. A complete copy of the Air Force evaluation is attached at Exhibit C . The Air Force has indicated that the entry for the Brazilian PME course was missing from the applicant's Officer Selection Brief (OSB) reviewed by the CY97C board.
A complete copy of this Air Force evaluation is attached at Exhibit C. applicant contends that The Chief, Officer Promotion and Appointment Branch, HQ AFPC/DPPPO, states that the aeronautical/flying data reflected on his OSB is incorrect. After a thorough review of the evidence of record and applicant's submission, we are not persuaded that hisofficer Selection Brief 4 (OSB), reviewed by the Calendar Year 1997C (CY97C) Central Lieutenant Colonel Selection Board, should be corrected...
The citation for the MSM covering the period 1 March 1994 to 27 July 1998 at Robins AFB, GA, be removed and replaced with the citation for the MSM covering the period 1 March 1994 to 27 July 1996 at Robins AFB, GA, and the awarding date be changed so that it can be included in her records for consideration for promotion to the grade of lieutenant colonel (LTC) by Special Selection Board (SSB) for the Calendar Year 1997C (CY97C) LTC Board. However, the basic MSM citation, which was filed in...
c. The Promotion Recommendation Form (PRF) reviewed by the CY97C board reflect an overall recommendation of “Definitely Promote (DP).” 3. He was promoted by SSB to major with annotations on his top two OPRs, and subsequently promoted APZ to LTC with the AF Form 77 and four OPRs with annotations in his records. He contends, in part, that his unnecessary break in service and the annotated documents in his records caused the MLR board not to award him a “DP” on the CY97C PRF and the promotion...

While the delay was not in violation of the applicable regulation, we believe that had it not been for the two-year backlog of awards the squadron had to deal with, the AAM would have been awarded sooner and placed in his record prior to the convening of the CY97C selection board. In view of the 3 97- 03 138 foregoing and in an effort to remove any possibility of an injustice to the applicant, we recommend that his record, to include the AAM for the period 3 June 1993 through 5...
