Applicant requests he be awarded the Humanitarian Service Medal.

The appropriate Air Force office evaluated applicant's request
and provided an advisory opinion to the Board recommending the
application be denied (Exhibit C). The advisory opinion was
forwarded to the applicant for review and response (Exhibit D).
Applicant's response to the advisory opinion is at Exhibit E.
After careful consideration of applicant's request and the
available evidence of record, we find insufficient evidence of
error or injustice to warrant corrective action. The facts and
opinions stated in the advisory opinion appear to be based on the
evidence of record and have not been adequately rebutted by
applicant.
Absent persuasive evidence applicant was denied
rights to which entitled, appropriate regulations were not
followed, or appropriate standards were not applied, we find no
basis to disturb the existing record.
Accordingly, applicant's request is denied.
The Board staff is directed to inform applicant of this decision.
Applicant should also be informed that this decision is final and
will only be reconsidered upon the presentation of new relevant
evidence which was not reasonably available at the time the
application was filed. .

The attached Application for Correction of Military Records submitted by the
applicant, a former member of the Missouri Ar National Guard, is forwarded for
your review and action.

This Headquarters recommends denial of relief. Per DoD 1348.33-M, Manual
of Military Decorations and Awards, in order to be eligible for award of the HSM,
the following criteria must be met: 1) the emergency assistance must have been of
a major significance; 2) the emergency assistance must have provided “immediate
relief;” 3) specific dates were designated for the period of “immediate relief‘ (periods
after the emergency conditions are considered ongoing operations and are no longer
eligible for the HSM); and 4) emergency assistance must have been requested by
the President of the United States, for assistance within the US or the Department
of State for overseas areas. Recommendations are submitted by the Commander in
Charge of emergency assistance missions, and if necessary, assistance from the
other services (including Guard and Reserve) is requested. The Office of the
Secretary of Defense (OSD) determines whether or not the relief effort meets the
criteria for award of the HSM. Individuals who directly participated in the effort
and are eligible for the award, must take appropriate action to have their records
