Applicant ’s Request

The application for discharge review was received on 20060605 . The Applicant requests the Discharge Characterization of Service received at the time of discharge be changed to honorable . The Applicant requests a personal appearance hearing before the Board in the Washington, D.C. Metropolitan area. The Applicant did not designate a representative on the DD Form 293. The Applicant’s scheduling notice was returned as undeliverable, therefore, a documentary review was conducted, and the Applicant is not eligible for further review by this Board.

Decision

A documentary discharge review was conducted in Washington, D.C. on 2007051 0 . After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant ’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain Under Other Than Honorable Conditions by reason of misconduct due to a pattern of misconduct .

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 19930219 by reason of misconduct due to a pattern of misconduct (A and B) with a service characterization of under other than honorable conditions. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D). The Board presumed regularity in the conduct of governmental affairs (E).

Equity: Quality of Service: The Applicant is claiming he was a Gulf war veteran and most of his evaluations were good and at least deserving of a chance to be heard in a hearing.

When the service of a member of the U.S. Navy has been honest and faithful, it is appropriate to characterize that service as honorable. An under other than honorable conditions discharge is warranted when significant negative aspects of a member’s conduct or performance of duty outweigh the positive aspects of the member’s military record. The Applicant’s service was marred by 2 retention warnings and 3 nonjudicial punishment proceedings for violations of Articles 90 (Willfully disobeying a superior commissioned officer), 121 (Larceny) and 134 ( Soliciting another to commit an offense) of the UCMJ. The Applicant’s conduct, which forms the primary basis for determining the character of his service, reflects his willful failure to meet the requirements of his contract with the U.S. Navy and falls far short of that required for an upgrade of his characterization of service. Relief is not warranted.

Equity: Minor offenses: The Applicant claims the charges brought against him were minor offenses.

The Applicant was charged with violations of Articles 90 (Willfully disobeying a superior commissioned officer), 121 (Larceny) and 134 (Soliciting another to commit an offense) of the UCMJ. Each of these violations is considered serious offenses which warrant a punitive discharge if tried and found guilty of in a special or general courts-martial hearing. Relief is denied.

Propriety: Due Process: The Applicant claims he was not given the chance to properly defend himself from accusations which lead to him being discharged for misconduct.

On 19930119 the Applicant was advised of rights and having elected not to consult with counsel, elected to waive all rights concerning his discharge process. There is no evidence in the record, nor has the Applicant produced any evidence, to support the contention that he was not given the chance to properly defend himself from the charges which lead to him being discharged for misconduct. The Applicant’s statements alone do not overcome the government’s presumption of regularity in this case. Relief is denied.
