Applicant ’s Request

The application for discharge review was received on 20060523 . The Applicant requests the Discharge Characterization of Service received at the time of discharge be changed to general (under honorable conditions) . The Applicant requests a personal appearance hearing before the Board in the Washington, D.C. Metropolitan area . The Applicant did not designate a representative on the DD Form 293. Subsequent to the application, the Applicant obtained representation by the American Legion.

Decision

A personal appearance hearing discharge review was conducted in Washington, D.C. on 20070808. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety in the discharge action and no inequity in the characterization of the Applicant’s service. The Board’s vote was unanimous that the characterization of the discharge and the narrative reason for discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT.

NASSAU LHA-4 Medical Dept. 22 year old reports to sick call with compliant of migraine headache since last night. Patient states the headache is located in front of skull. Patient was in a motor vehicle accident about 4-5 weeks ago. Patient states pain is in the area where he received sutures. Patient describes pain as throbbing, none radiant, rating a 9. Patient states that the slightest noise makes headache worse. Patient states he gets headaches QOD with some relief with meds.

The patient was in his usual state of mental health until Feb 2000 when he learned his father had been assaulted and was on life support in a hospital. He went on UA on 3 separate occasions (totaling more than 60 days).

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 20001015 by reason of misconduct due to a pattern of misconduct (A and B) with a service characterization of under other than honorable conditions. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D). The Board presumed regularity in the conduct of governmental affairs (E).

The Applicant contends that his characterization of service is inequitable based upon his exceptional and trying family circumstances. While he may feel that his trying family circumstances was the underlying cause of his misconduct, the record clearly reflects his willful misconduct and demonstrated he was unfit for further service. The evidence of record did not show that the Applicant was either not responsible for his conduct or that he should not be held accountable for his actions.

The Applicant submitted additional documentation to support his post service equity claim. There is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service. The NDRB is authorized to consider outstanding post-service factors in the recharacterization of a discharge, to the extent that such matters provide a basis for a more thorough understanding of the Applicant’s performance and conduct during the period of service under review. After a complete review of the entire record, including the evidence submitted by the Applicant, the Board determined that the discharge was appropriate and that the evidence of post-service conduct was found not to mitigate the conduct, which precipitated the discharge.

The Applicant claims his 2 previous nonjudicial punishments were not warranted. When the service of a member of the U.S. Navy has been honest and faithful, it is appropriate to characterize that service as honorable. An under other than honorable conditions discharge is warranted when significant negative aspects of a member’s conduct or performance of duty outweigh the positive aspects of the member’s military record. The Applicant’s service was marred by 2 retention warnings, 2 nonjudicial punishment proceedings for violations of UCMJ Articles 91 (Insubordinate conduct toward non-commissioned officer), 92 (Failure to obey order), 117 (Provoking speeches and gestures) and 128 (Assault). The Applicant also received a summary court martial for violation of UCMJ Articles 86 (Unauthorized Absence) and 87 (Missing movement). The Applicant’s conduct, which forms the primary basis for determining the character of his service, reflects his willful failure to meet the requirements of his contract with the U.S. Navy and falls far short of that required for an upgrade of his characterization of service.

The following is provided for the edification of the Applicant. The Applicant has exhausted his opportunities for review by the NDRB. The Applicant may, however, petition the Board of Correction of Naval Records (BCNR), 2 Navy annex, Washington, DC 20370-5100, concerning a change in the characterization of naval service, if he desires further review of his case.
