Applicant’s Request

The application for discharge review was received on 20051017. The Applicant requests the Discharge Characterization of Service received at the time of discharge be changed to honorable. The Applicant requests a documentary record discharge review. The Applicant did not designate a representative on the DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 20060810. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain Under Other Than Honorable Conditions by reason of
misconduct due to commission of a serious offense .

“I request an upgrade of discharge because of condition of my discharge from the military. I requested discharge from the military because of an unfair NJP ruling where I was later proven innocent.
I want an upgrade because I am pursuing a career in law enforcement and need an honorable discharge in order to meet minimum requirements.”

NJP for Charge 2: Violation of UCMJ, Article 134:
Specification: In that EM3 K_ K. G_ (Applicant), USS BATAAN, on active duty, did on board USS BATAAN, located at Naples, Italy, on or about December 1999, wrongfully take certain mail matte, to wit: two letters addressed to EM2 J_ E. B_, U.S. Navy, out of divisional mail box before they were delivered with intent to pry into the business of EM2 J_ E. B_, U. S. Navy.
         Award: Forfeiture of $563.00 pay per month for 2 months (suspended all except $500.00 for 6 months), restriction and extra duty for 45 days, reduction to E-3. No indication of appeal in the record.

         Award: Forfeiture of $653.00 pay per month for 2 months (1 month suspended for 6 months), restriction for 60 days (15 days suspended for 6 months), reduction to E-3. No indication of appeal in the record.

010413:  Applicant notified of intended recommendation for discharge with the least favorable characterization of service under other than honorable conditions by reason of misconduct due to pattern of misconduct and misconduct due to commission of a serious offense.

010413:  Applicant advised of rights and having elected not to consult with counsel, elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation.

010507:  Commanding Officer, USS BATAAN (LHD 5), to Commander, Amphibious Group TWO, that the Applicant be discharged under other than honorable conditions by reason of misconduct due to a pattern of misconduct, and misconduct due to a commission of a serious offense. Commanding Officer’s comments: “All reasonable available attempts to rehabilitate EMFN G_ (Applicant) have been unsuccessful. He apparently is incapable of adhering to the rules and regulations of this command and the United States Navy, and is simply unwilling to conduct himself in a manner conducive to good order and discipline. His conduct falls within the parameters of references (a) and (b). I therefore strongly recommend that EMFN G_ (Applicant) be separated from the naval service and that he receives an Other Than Honorable characterization of service.”

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 20010621 by reason of misconduct due to commission of a serious offense (A and B) with a service characterization of under other than honorable conditions. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

In the Applicant’s case, the Board found no credible evidence in the record nor did he offer any evidence to support his assertions that there was impropriety in his nonjudicial punishment nor is an upgrade of his discharge warranted. When the service of a member of the U.S. Navy has been honest and faithful, it is appropriate to characterize that service as honorable. An under other than honorable conditions discharge is warranted when significant negative aspects of a member’s conduct or performance of duty outweigh the positive aspects of the member’s military record. The Applicant’s service was marred by a retention warning and two nonjudicial punishment proceedings for four violations of UCMJ Article 121 (larceny) and one violation of Article 134 (taking mail matter). A punitive discharge is authorized under the UCMJ for violations of Articles121 and 134. The Applicant’s conduct, which forms the primary basis for determining the character of his service, reflects his willful failure to meet the requirements of his contract with the U.S. Navy and falls far short of that required for an upgrade of his characterization of service. Relief is not warranted.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide documentation to support any claims of post-service accomplishments or any additional evidence related to this discharge. Representation at a personal appearance hearing is recommended but not required.
