Applicant ’s Request

The application for discharge review was received on 20060622 . The Applicant requests the Discharge Characterization of Service received at the time of discharge be changed to honorable . The Applicant requests a documentary record discharge review. The Applicant did not designate a representative on the DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 20070322 . After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant ’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain ( General) Under Honorable Conditions) by reason of weight control failure.


The NDRB did note administrative error(s) on the original DD Form 214. Block 12a, Date Entered AD This Period, should read: “91 08 12,” Block 18, Remarks, should read: “CONTINUOUS HONORABLE ACTIVE DUTY FROM 910812 UNTIL 941104 ,” and Block 2 4 , Character of Service, should read: GENERAL (UNDER HONORABLE CONDITIONS. ” The Commandant, Headquarters USMC, Quantico, VA, will be notified, recommending the DD Form 214 be corrected or reissued, as appropriate.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 19970630 by reason of weight control failure (A) with a service characterization of general (under honorable conditions). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (B and C).

When a Marine’s service has been honest and faithful, it is appropriate to characterize that service under honorable conditions. Characterization of service as general (under honorable conditions) is warranted when significant negative aspects of a member's conduct or performance of duty outweigh the positive aspects of the member's military record. The Applicant’s period of service under review was marred by 2 assignments to the weight control program, during which he gained weight rather than lose it. The Board noted that the Applicant had apparently received an approved alternate weight standard which he also failed to meet. In addition to failing to maintain weight standards, the Applicant received an adverse fitness report regarding “snide, disrespectful comments” and their impact on mission accomplishment. The Board noted that these fitness report comments came from the same Reporting Senior and Reviewing Officer who had favorably assessed his performance on a previous fitness report, and were supported by the Third Officer Sighting the report. The Board considered the fact that this aspect of Applicant’s behavior and his failure to maintain appropriate weight standards, especially in light of his position as a noncommissioned officer (Sergeant) in a school training environment attended by very junior, impressionable, basic Marines, were significant negative aspects of conduct which outweighed the positive aspects of his record during the period of service under review. Relief is not warranted.

The Veterans Administration determines eligibility for post-service benefits, not the Naval Discharge Review Board. There is no requirement or law that grants recharacterization solely on the issue of obtaining Veterans' benefits and this issue does not serve to provide a foundation upon which the Board can grant relief. Additionally, the Board has no authority to upgrade a discharge for the sole purpose of enhancing employment or educational opportunities. Regulations limit the Board’s review to a determination of the propriety and equity of the discharge.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide documentation to support any claims of post-service accomplishments or any additional evidence related to this discharge. Representation at a personal appearance hearing is recommended but not required.
