Applicant’s Request

The application for discharge review was received on 20051227 . The Applicant requests the Discharge Characterization of Service received at the time of discharge be changed to honorable . The Applicant requests a documentary record discharge review. The Applicant did not designate a representative on the DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 20061102 . After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain as a bad conduct discharge by reason of court-marital.

My discharge was based on incidents that were uncharacterized for my behavior because I had 3 years and 6 months of good conduct and behavior. I had sessions with psychiatrist before and after the incidents occurred . After my discharge, I have been diagnosed with schizophrenia and I am receiving treatment through mental health services. Therefore, I am asking consideration for an upgrade in status.

S_(Applicant), Jr., U.S. Marine Corps, on active duty, Marine Attack Training Squadron 203, Marine Aircraft Group 14, 2d Marine Aircraft Wing, U.S. Marine Forces, Atlantic, did on or about 000228, without authority, fail to go at the time prescribed to his appointed place of duty, to wit: 1630, work section, Marine Attack Training Squadron 203, Marine Aircraft Group 14, 2d Marine Aircraft Wing, U.S. Marine Forces, Atlantic.
         Article 89:
         Specification: In that Private G_ R. S_, Jr., U.S. Marine Corps, on active duty, Marine Attack Training Squadron 203, Marine Aircraft Group 14, 2d Marine Aircraft Wing, U.S. Marine Forces, Atlantic, did on board Marine Corps Air Station. Cherry Point, North Carolina, on or about 000228, behave himself with disrespect toward Lieutenant Colonel K. C_, his superior commissioned officer, then known by the said Private S_ to be his superior commissioned officer, by saying ‘F--- this, I’m out of here!” and then storming out of Lieutenant Colonel C_’s office, and failing to stop when ordered to do so.
         Article 91:
         Specification: In that Private G_ R. S_, Jr., U.S. Marine Corps, on active duty, Marine Attack Training Squadron 203, Marine Aircraft Group 14, 2d Marine Aircraft Wing, U.S. Marine Forces, Atlantic, on board Marine Corps Air Station, Cherry Point, North Carolina, on or about 000228, was disrespectful in language and deportment toward Sergeant J_ H_, U.S. Marine Corps, a noncommissioned officer, then known by the said Private S_ to be a noncommissioned officer, who was then in the execution of his office, by saying to him, “If I go back to the barracks, I’m not returning to work,” or words to that effect.
         Article 112a:

000407:  Inquiry into the mental responsibility and capacity of Applicant at Psychology D epartment, Naval Hospital, MCAS Cherry Point, NC by D. W_ L_, Ph.D., LT, MSC, USNR and C_ N_, Psy. D., LT, MSC, USN R . A clinical psychological interview was conducted by LT L_ on 000328 in the Psychology Department, Naval Hospital, MCAS. The Board makes the following findings:
         a. At the time of the alleged criminal conduct, PFC S_( Applicant ) did not have a severe mental disease or defect.
         b. The clinical psychiatric diagnoses are:

         c. At the time of the alleged criminal conduct, the accused did not suffer from a severe mental disease or defect that would interfere with his capacity to appreciate the nature and quality or wrongfulness of his conduct.
         d. The accused has the sufficient mental capacity to understand the nature of the proceedings against him and to conduct or cooperate intelligently in his defense.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 20020722 with a bad conduct discharge which was the sentence adjudged by a properly convened special court-martial. That sentence was subsequently approved by both the convening and appellate review authorities (A and B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the Applicant’s issues were insufficient to merit clemency (C).

In response to the Applicant’s issue and with respect to a discharge adjudged by a court-martial case, the action of the NDRB is restricted to upgrades based on clemency. Clemency is an act of leniency that reduces the severity of the punishment imposed. The Applicant implies that clemency is warranted due to the Applicant’s in-service psychiatric treatment and post-service diagnosis of schizophrenia. The Applicant also implies clemency is warranted due to the Applicant’s “3 years and 6 months of good conduct and behavior.” After a thorough review of the Applicant’s record, issues submitted, and post service documentation, the Board determined that clemency was not warranted and that the sentence awarded the Applicant at his court-martial was appropriate for the offenses he committed. Relief denied.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. Representation at a personal appearance hearing is recommended but not required.


Pertinent Regulation/Law (at time of discharge)

A. Paragraph 1105, DISCHARGE ADJUDGED BY SENTENCE OF COURT-MARTIAL , of the Marine Corps Separation and Retirement Manual, (MCO P1900.16F), effective 01 September 2001 until Present.

B. The Manual for Courts-Martial authorizes the award of a punitive discharge if adjudged as part of the sentence upon conviction by a special or general court-martial for violation of the UCMJ, Article 89, disrespect toward a superior commissioned officer, Article 91, insubordinate conduct or Article 112a, wrongful use of a controlled substance.
