Applicant ’s Request

The application for discharge review was received on 20051227 . The Applicant requests the Discharge Characterization of Service received at the time of discharge be changed to honorable . The Applicant requested a personal appearance discharge review before a traveling panel closest to Chicago, IL. In the acknowledgement letter, the Applicant was informed that the Naval Discharge Review Board (NDRB) does not travel; all hearings are held in the Washington National Capital Region. The Applicant did not designate a representative on the DD Form 293. Subsequent to the submission of the application, the Applicant indicated he would be represented by the American Legion.

Decision

A personal appearance discharge review was conducted in Washington, D.C. on 20070411. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant ’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain Under Other Than Honorable Conditions by reason of misconduct due to drug abuse.

901102 :  Medical evaluation at ER Hospital Twentynine Palms
         30 year old male present for counseling on cocaine addiction. Apparently he has been through rehab but this AM was overwhelmed by obsession to smoke crack - took his entire paycheck of $300 and spent it [unreadable] . Now both money and drugs are exhausted and pt wishes directions f or recovery.
         Assessment /Diagnosis: Cocaine abuse.
         Plan: Referred to Marine Corps Drug Rehabilitation.

910222:  NJP for violation of UCMJ, Article 112a: On or about 910115 did wrongfully use some amount of cocaine at StudCoB, ScolsBn, MCCES, MGAGCC.
         Award: Restriction for 60 days, reduction to E-1. Not appealed.

910311 Applicant notified of intended recommendation for discharge with the least favorable characterization of service as under other than honorable conditions by reason of misconduct due to drug abuse. The factual basis for this recommendation was failu re to conform to the standards of the Marine Corps . Applicant informed the least favorable character of service possible was under other than honorable conditions.

910315 :  GCMCA, Commanding General, Marine Corps Air Ground Combat Center, Twentynine Palms, California , directed the Applicant 's discharge under other than honorable conditions by reason of misconduct, specifically, drug abuse.

910328:  Applicant evaluated by a medical officer and diagnosed as being drug or alcohol dependent. Applicant does not desire to enroll in the Veteran’s Administration Drug and Alcohol Program in conjunction with discharge. [Document submitted by Applicant.]

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 19910405 by reason of misconduct due to drug abuse (A) with a service characterization of under other than honorable conditions. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (B and C). The Board presumed regularity in the conduct of governmental affairs (D).

Issue 1. The Applicant contends that his drug and alcohol dependence impaired his ability to serve and caused his violations of the UCMJ. The evidence of record shows that the Applicant was briefed on and certified understanding of the Marine Corps policy concerning illegal drugs. Despite the Applicant’s claim of addiction, the evidence of record does not demonstrate that the Applicant was not responsible for his conduct or that he should not be held accountable for his actions. The evidence of record shows the Applicant used cocaine in November 1990 and January 1991. Mandatory processing for separation is required for Marines who abuse illegal drugs. Separation under these conditions generally results in characterization of service under other than honorable conditions. Relief denied.

Issue 2. The Applicant requests the Board consider relief on the basis of post-service conduct. The NDRB is authorized to consider post-service factors in the recharacterization of a discharge to the extent such matters provide a basis for a more thorough understanding of the Applicant’s performance and conduct during the period of service under review. Examples of documentation that may be provided to the Board include proof of educational pursuits, verifiable employment records, documentation of community service, credible evidence of a substance free lifestyle and certification of non-involvement with civil authorities. After a complete review of the entire record, including the evidence submitted by the Applicant, the Board determined that the discharge was appropriate and that the evidence of post-service conduct was found not to mitigate the conduct which precipitated the discharge. Relief denied.

The following is provided for the edification of the Applicant. The Applicant has exhausted his opportunities for review by the NDRB. The Applicant may, however, petition the Board for Correction of Naval Records (BCNR), 2 Navy Annex, Washington, DC 20370-5100, concerning a change in the characterization of Naval service, if he desires further review of his case.
