Applicant’s Request

The application for discharge review was received on 20050914. The Applicant requests the Discharge Characterization of Service received at the time of discharge be changed to general (under honorable conditions) or entry level separation or uncharacterized. The Applicant requests a documentary record discharge review. The Applicant did not designate a representative on the DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 20060614. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain Under Other Than Honorable Conditions by reason of misconduct due to drug abuse.

“Request the Board review the last 6 months of my active duty. I still did my job on board USS GEORGE WASHINGTON but received no payment of salary during that time. I truly loved being in the military and regret that my Captain saw fit to discharge me because of a stupid mistake instead of giving me another chance. I believe that even though I was not allowed to complete my contract that I still did my duty to the fullest of my abilities and I hope you see that as well.”

Commanding Officer’s comments: “AR A_ (Applicant) has demonstrated a complete inability to conform to the standards and requirements of the Navy. His behavior and continued presence are detrimental to morale and good order in this command. He has no potential for continued service, therefore, I recommend that AR A_ (Applicant) be separated from the Naval service with an Other than Honorable discharge.”

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 2000508 by reason of misconduct due to drug abuse (A and B) with a service characterization of under other than honorable conditions. After a thorough review of the available records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D). The Board presumed regularity in the conduct of governmental affairs (E).

The government enjoys a presumption of regularity in the conduct of its affairs. The Applicant bears the burden of overcoming this presumption through the presentation of substantial and credible evidence to support his issue. The service record contains a partial discharge package and is missing elements of the summary of service. The Board presumed the Applicant was advised of his rights and provided the opportunity to consult with counsel, elected or waived each right, evaluated for drug dependence, and if dependent he was offered treatment. The Applicant’s statements alone do not overcome the government’s presumption of regularity in this case.

The Applicant contends that he did his duty to the fullest of abilities. He states that he was discharged for “a stupid mistake instead of giving me a second chance.” The Board discovered no impropriety after a review of Applicant’s case. There is credible evidence in the record that the Applicant used illegal drugs. Mandatory processing for separation is required for sailors who abuse illegal drugs. Separation under these conditions generally results in characterization of service under other than honorable conditions. Additionally, the Applicant’s service was marred by three nonjudicial punishment proceedings for violations of Articles 86 (9 specs), 87, and 112a of the UCMJ. The Applicant’s conduct, which forms the primary basis for determining the character of his service, reflects his willful failure to meet the requirements of his contract with the U.S. Navy and falls far short of that required for an upgrade of his characterization of service. Relief is denied.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide documentation to support any claims of post-service accomplishments or any additional evidence related to this discharge. Representation at a personal appearance hearing is recommended but not required.

A . The Naval Military Personnel Manual, (NAVPERS 15560C), Change 27, effective 27 March 2000 - 11 Feb 2001, Article 1910-146 (formerly 3630620), Separation by Reason of Misconduct - Drug Abuse.

B. The Manual for Courts-Martial authorizes the award of a punitive discharge if adjudged as part of the sentence upon conviction by a special or general court-martial for violation of the UCMJ, Article 87 – missing movement and Article 112a – wrongful use of cocaine.
