Applicant’s Request

The application for discharge review was received on 20050328. The Applicant requests the Discharge Characterization of Service received at the time of discharge be changed to honorable. The Applicant requests a documentary record discharge review. The Applicant did not designate a representative on the DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 20050908. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain Under Other Than Honorable Conditions by reason of misconduct due to commission of a serious offense.

“Because, at the time of my service, I was suffering from the disease of alcoholism since age 15. Since my discharge, I committed myself to treatment and now been sober for 5 years.”

“To whom it may concern: First of all, I want to say that I am very thankful of the opportunity to have serve in the Navy and for Navy having to put up with my foolishness. I regret that I didn’t represent our armed forces in the manner for the pride and integrity for what it stands. I am ashamed and disappointed of my tenure and I do apologize.
With that said, I can’t do anything about the past, but the present and future and that is why I am writing this letter in-regards to my Discharge Upgrade. I am enclosing some of awards and accomplishments while I was in the Navy and discharge from the Navy to hopefully demonstrate my worthiness of this honor, it is with this honor that I hope the Board of Correction of Military Records will review these awards and accomplishments.
As my military records reflect, the reason of my discharge was due to a series of unauthorized absence due to my bout with alcohol. Since my discharge, I immediately went to work on this problem which has pledge me for 25 years of my life by checking into a 6-month in-patient program, dating from: 6-98 to 12-98 and from: 11-99 to 2000, overall spending 1-year in alcohol rehabilitation to indicate seriousness of my problem. Since my commitment and completion of the program, I am approaching 5-years of sobriety to validate that point is a letter from the owner/manager of the sober living facility at which I have been living. As you can see, I have made the most of my time after being discharge from the Navy and it is my goal to continue in this quest.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 19980610 by reason of misconduct due to commission of a serious offense (A and B) with a service characterization of under other than honorable conditions. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D). The Board presumed regularity in the conduct of governmental affairs (E).

When the service of a member of the U.S. Navy has been honest and faithful, it is appropriate to characterize that service as honorable. An under other than honorable conditions discharge is warranted when significant negative aspects of a member’s conduct or performance of duty outweigh the positive aspects of the member’s military record. The Applicant’s service was marred by nonjudicial punishment proceedings and a summary court-martial conviction for violations of Articles 86, 87 and 134 of the UCMJ. The Applicant committed at least six violations of Article 86 and his violation of Article 87 is considered the commission of a serious offense. The Applicant signed an Aftercare Treatment Plan on 19970405 and was subsequently considered a failure as a result of missing three aftercare group counselings. The Applicant’s frequent misconduct is considered a violation of the special consideration given to the Applicant during his enlistment process evidenced by the Applicant’s enlistment waiver for driving under the influence. The Applicant’s conduct, which forms the primary basis for determining the character of his service, reflects his willful failure to meet the requirements of his contract with the U.S. Navy and falls far short of that required for an upgrade of his characterization of service. Relief is not warranted.

Normally, to permit relief, a procedural impropriety or inequity must have occurred during the discharge process for the period of enlistment in question. The Board discovered no impropriety after a review of Applicant’s case. There is no law or regulation, which provides that an unfavorable discharge may be upgraded, based solely on the passage of time or good conduct in civilian life subsequent to leaving Naval service. The NDRB is authorized to consider post-service factors in the recharacterization of a discharge to the extent such matters provide a basis for a more thorough understanding of the Applicant’s performance and conduct during the period of service under review. While the Board was impressed with the Applicant’s accomplishments in battling his alcoholism and his years of sobriety, the Applicant’s efforts need to be more encompassing. Examples of documentation that should be provided to the Board include proof of educational pursuits, verifiable employment records and certification of non-involvement with civil authorities. As of this time, the Applicant has not provided sufficient post-service documentation for the Board to consider. Relief denied.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. Representation at a personal appearance hearing is recommended but not required.
