Applicant’s Request

The application for discharge review was received on 20050203. The Applicant requested a documentary record discharge review and that his characterization of service be changed to honorable. The Applicant designated Veterans Service Organization as the representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 20060504. After a thorough review of all available records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the characterization of the discharge shall not change. The discharge shall remain as a bad conduct discharge by reason of court-martial conviction.




PART I - APPLICANT’S ISSUES AND DOCUMENTATION

Applicant’s issues, as stated on the application:

“REQUEST UPGRADE TO HONORABLE TO FURTHER JOB PROSPECTS AND EDUCATIONAL OPPORTUNITIES. JUSTIFICATION BEING THAT I DID SERVE MY COUNTRY VOLUNTARILY AND HONORABLY FOR INITIAL ENLISTMENT PERIOD OF 4 YEARS. I HAVE HELD JOBS SINCE MY SEPARATION AND AM A TAX PAYER AND VOTER. I REGULARLY ATTEND CHURCH AND BIBLE STUDY. I AM SORRY THAT I COMMITTED THE OFFENSE AT THE INCONVENIENCE OF MY COMMAND AND THE U.S NAVY. I ENJOYED SERVING AS A SAILOR AND APPRECIATE ANY ASSISTANCE A BOARD OF REVIEW CAN SERVE IN MY FAVOR. THIS PAST 7 OR 8 YEARS HAS NOT BEEN EASY IN ANYWAY AND I PLEAD FOR MERCY IN THIS MATTER. “LOOKING BACK AT “MY” MILITARY SERVICE, ITS DIFFICULT TO HAVE ANY PRIDE IN MYSELF AND MY NAME. MY GRANDFATHER SERVED IN THE ARMY IN WORLD WAR II AND WAS KILLED IN ACTION IN FRANCE. MY BROTHER SERVED 6 YEARS IN THE MARINE CORPS. MY FATHER WHO PAST AWAY IN JAN 2001, WORKED FOR THE INDIANA DEPT OF NATURAL RESOURCES-DIVISION OF FISH AND WILDLIFE FOR 35 YEARS. MY GRANDFATHER WHO JUST TURNED 86 SERVED IN THE NAVY DURING WORLD WAR II. AFTER ALL OF THEIR MILITARY SERVICE AND SERVICE OF THE STATE I CAN ONLY ADMIRE THEIR HONORABLE SERVICE AND SACRIFICE, WHEN I GAVE UP SEVERAL VALUABLE YEARS OF MY YOUNG ADULT LIFE ONLY FOR SELF DESTRUCTION AND SHAME!”

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged in absentia on 19970725 with a bad conduct discharge which was the sentence adjudged by a properly convened special court-martial. Both the convening and appellate review authorities subsequently approved the sentence (A and B). After a thorough review of all available records, supporting documents, facts, and circumstances unique to this case, the Board found that the Applicant’s issues were insufficient to merit clemency (C).

With respect to a discharge adjudged by a court-martial, the action of the NDRB is restricted to upgrades based on clemency. Clemency is an act of leniency that reduces the severity of the punishment imposed. The Applicant’s case was considered under the pertinent standards of equity to determine if any factors in this particular case merited clemency. After a thorough review of the Applicant’s record, issues, and post service accomplishments, the Board determined these factors insufficient to mitigate the seriousness of the offenses for which the discharge was awarded. Clemency is not warranted, relief denied.

The Applicant requested an upgrade to the characterization of his service to facilitate his obtaining more favorable employment and the use of educational benefits. There is no requirement or law that grants recharacterization on the issue of obtaining Veterans' benefits and this issue does not serve to provide a foundation upon which the Board can grant relief. Additionally, the Board has no authority to upgrade a discharge for the purpose of enhancing medical, housing, employment or educational opportunities. Regulations limit the Board’s review to a determination on the propriety and equity of the discharge. This issue is without merit. Relief is not warranted.

The NDRB is authorized to consider post-service factors in the recharacterization of a discharge to the extent such matters provide a basis for a more thorough understanding of the Applicant’s performance and conduct during the period of service under review. Examples of documentation that should be provided to the Board include proof of educational pursuits, verifiable employment records, documentation of community service, and certification of non-involvement with civil authorities. The Applicant stated that he is employed, pays taxes, votes, and attends church. The Board concluded that the Applicant’s unsubstantiated post service conduct is insufficient to mitigate his misconduct by while in the Naval service. Relief denied.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide documentation to support any claims of post-service accomplishments or any other evidence related to his discharge at that time. Representation at a personal appearance hearing is recommended but not required.
