Applicant’s Request

The application for discharge review was received on 20050202. The Applicant requests the characterization of service received at the time of discharge be changed to honorable.
The Applicant requests a personal appearance hearing before the board in the Washington, D.C. Metropolitan area. In the acknowledgement letter, the Applicant was informed that the Naval Discharge Review Board (NDRB) first conducts a documentary review prior to any personal appearance hearing. The Applicant did not list any representative on the DD Form 293.

Decision

A documentary review was conducted in Washington, D.C. on 20050608. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: GENERAL (UNDER HONORABLE CONDITIONS)/PATTERN OF MISCONDUCT, authority: NAVMILPERSMAN, Article 1910-140 (formerly 3630600).

1. “I BELIEVE MY DISCHARGE SHOULD BE UPGRADED BECAUSE WHILE SERVING IN THE USN I WAS A SUPERIOR SAILOR. I RECEIVED HONORS WHILE ACHIEVING JUNIOR SAILOR OF THE QUATER BECOMING DECKS LEADING SEAMAN RECEIVING A MUST PROMOTE ON MY EVALUATIONS. WHILE IN SERVING IN THE MILITARY I WAS GIVEN MINIMAL INSTRUCTIONS ON JOB ASSIGNMENTS WHILE FINISHING MY ASSIGNMENTS ON TIME AND IN A PRODUCTIVE MANNER. I NEVER ONCE GOT INTO ANY TROUBLE ABOARD MY COMMAND UNTIL MY PERSONAL LIFE BECAME AN ISSUE. I BELIEVE EVERYONE MAKES MISTAKES AND I’VE HAD MY SHARE. IN MY HEART I SERVED MY COUNTRY TO THE BEST OF MY ABILITY WITH HONOR, COURAGE AND COMMITMENT. Specification: In that Seaman Q_ J. B_ (Applicant), United States Navy, on board RESOLUTE, Norfolk Virginia, on or about 24 October 2003, was arrested for disorderly conduct and behaved in a manner which brought discredit upon the armed forces, deviated from the good order and discipline expected of Sailors.
         Award: Dismissed with warning and reprimanded. Ordered: Family Advocacy for Anger Management.

Retention Warning: Advised of deficiency (Disorderly conduct.), notified of corrective actions and assistance available, advised of consequences of further deficiencies, and issued discharge warning.

031212:  NJP for violation of UCMJ, Article 92: Failure to obey lawful order.
Specification: In that, BM3 Q_ J. B_ (Applicant), United States Navy, RESOLUTE (AFDM 10), Norfolk, VA, having been given a Military Protective Order (MPO) dated 20 November 2003 to 19 December 2003 by Commanding Officer RESOLUTE (AFDM 10) ordering her not to have any contact with FN M_ R. R_, (SS#), did on or about 09 December 2003 break into FN R_ barracks room and was apprehended by Sewell’s Point Police for breaking and entering. When confronted by her chain-of-command the morning of 10 December 2003, she admitted to breaking into FN R_’s room and having contact with FN R_, on many occasions, since being given the MPO.
         Award: Restriction and extra duty for 45 days (suspended for 6 months), reduction to E-3 (suspended for 6 months). No indication of appeal in the record.

Commanding Officer’s comments (verbatim): SA B_ (Applicant) has become an ever-increasing burden on the U. S. Navy. In addition to the three Captain’s mast she has been to, she has had several court appearances for various minor civilian problems. These problems range from assault charges and failure to pay debts. SA B_ (Applicant) has problems with authority and lacks the potential for continued naval service. Per reference (a) [MILPERSMAN 1910-140], she is being processed for administrative separation. I recommend that she be separated from the United States Navy with an Other Than Honorable discharge.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 20040401 with a general (under honorable conditions) for misconduct due to a pattern of misconduct (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issue 1. Normally, to permit relief, an impropriety or inequity must have existed during the period of enlistment in question. No such impropriety or inequity is evident during the Applicant’s enlistment. The Applicant contends that she served the United States well and she is entitled to an upgrade.
When the service of a member of the U.S. Navy has been honest and faithful, it is appropriate to characterize that service as honorable. An under other than honorable conditions discharge is warranted when significant negative aspects of a member's conduct or performance of duty outweigh the positive aspects of the member's military record. T he Applicant’s service was marred by disorderly conduct, orders violations, and a civilian conviction for making obscene phone calls. This misconduct resulted in three separate nonjudicial punishment proceedings for violations of UCMJ Articles 92 and 134. The Applicant’s conduct, which forms the primary basis for determining the character of her service, reflects her willful failure to meet the requirements of her contract with the U.S. Navy. Such conduct falls far short of that expected of a member of the U.S. military and does not meet the requirements for an upgrade of her characterization of service. Relief is not warranted.

There is no requirement or law that grants recharacterization solely on the issue of enhancing or obtaining educational opportunities and this issue does not serve to provide a foundation upon which the Board can grant relief. Regulations limit the Board’s review to a determination on the propriety and equity of the discharge.

Since the NDRB has no jurisdiction over reenlistment, reentry, or reinstatement into the Navy, Marine Corps, or any other of the Armed Forces, NDRB is not authorized to change a reenlistment code. An unfavorable “RE” code is, in itself, not a bar to reenlistment. A request for a waiver can be submitted during the processing of a formal application for reenlistment through a recruiter. Only the Board for Correction of Naval Records (BCNR) can make changes to reenlistment codes.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. Representation at a personal appearance hearing is recommended but not required.
