Decision

A documentary review was conducted in Washington, D.C. on 20050511. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. Award: Forfeiture of $250.00 per month for 1 month, restriction and extra duty for 30 days, reduction to E-3 (suspended for 6 months). No indication of appeal in the record. The accused knowingly, intelligently and voluntarily accepted NJP.

910925:  Psychiatric Evaluation: Examination revealed him to be a self assured forceful individual who although acknowledging his alcoholism tended to minimize the impact of alcohol in his life. He admitted that he was reluctant to discuss his private life. He was not depressed. His thinking was relevant and coherent with no abnormal ideations elicited. He was cognitively intact. He denied pseudo-perceptions.
         Impression: Alcohol dependency. He meets DSM-III-R criteria 1,2,3,6, and 7. Recommendation: Level III treatment.

920701:  NJP for violation of UCMJ, Article 86: Unauthorized absence.
         Award: Forfeiture of five (5) days pay ($195.00) per month for 1 month, restriction and extra duty for 14 days, reduction to E-3 (suspended for 6 months). No indication of appeal in the record.

Retention Warning from Construction Battalion Unit 420, Mayport, FL 32228-0127: Advised of deficiency (Recurring unauthorized absences resulting in OIC’s NJP), notified of corrective actions and assistance available, advised of consequences of further deficiencies, and issued discharge warning.

920814:  Applicant advised of rights and having elected not to consult with counsel certified under UCMJ, Article 27(b), elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation. Applicant did not object to this separation.

920817:  Officer in Charge, Construction Battalion Unit 420 recommended BUCA T_ (Applicant) be separated with an under other than honorable conditions by reason of misconduct due to commission of a serious offense and misconduct due to a pattern of misconduct. Commanding Officer’s comments (verbatim): BUCA T_ (Applicant) has been counseled on numerous occasions concerning his habitual unauthorized absences. He has been unable to correct this problem and had become an administrative burden. Recommend immediate administrative separation with the characterization of separation as other than honorable as a result of his NJP with NMCB 133 for violation of UCMJ article 134 (2 specs) indecent exposure and communicating a threat.

920820:  Commanding Officer, Naval Station Mayport, recommended expeditious administrative separation.

920909:  BUPERS directed the Applicant's discharge under other than honorable conditions by reason of misconduct due to a pattern of misconduct.


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 19920918 under other than honorable conditions for misconduct due to a pattern of misconduct (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issue 1.
A characterization of service of under other than honorable conditions is warranted when the member's conduct constitutes a significant departure from that expected of a sailor. The Applicant’s service was marred by award of three nonjudicial punishment (NJP) proceedings for violations of UCMJ Articles 86 (Unauthorized absence), and Article 134 – 2 Specifications (Drunk/Disorderly/Indecent Exposure and Communicating a Threat). The Applicant’s conduct, which forms the primary basis for determining the character of his service, reflects his disobedience of the orders and directives which regulate good order and discipline in the naval service, and falls short of that required for an honorable characterization of service. Relief denied.

The Applicant contends that he requested three times to be separated from the naval service and was turned down each time. The record does not contain any documentation to the fact and the Applicant should be made aware that misconduct takes precedence over an administrative separation. Relief denied.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. Representation at a personal appearance hearing is recommended but not required.
