Applicant’s Request

The application for discharge review was received on 20050104. The Applicant requests the Discharge Characterization of Service received at the time of discharge be changed to general (under honorable conditions).
The Applicant requests a personal appearance hearing before the Board in the Washington, D.C. Metropolitan area. The Applicant designated a non-credentialed representative on the DD Form 293.

Decision

A personal appearance discharge review was conducted in Washington, D.C. on 20060405. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain Under Other Than Honorable Conditions by reason of unsatisfactory participation in the Ready Reserve.

th Supply Battalion Greenville, SC, I received promotion to LCpl. and Later received another recommendation for Meritorious Mass. I was a Marine should be. I then made some bad decisions which resulted in my discharge From the Marine Corps.

Issue 2. Equity. Since then I have been an active member in the church and community. I have moved from SC to Va. I am currently employed with Maytag Factory Services, were I am very productive, reliable, and courteous person. All of what made me an Outstanding Marine.

The factual basis for this recommendation was unexcused absences from eleven (11) scheduled drills: 4 May 00 (1), 5 May 00 (2), 6 May 00 (2), 7 May 00 (2), 10 Jun 00 (2) and 11 Jun 00 (2). 000811:  Commanding Officer/Inspector-Instructor, Ammunition Company (-), Greenville, recommended to Commander, Marine Forces Reserve (SJA), that the Applicant be discharged with an under other than honorable conditions by reason of unsatisfactory participation in the ready reserve for UNEXCUSED absences from scheduled drills. Commanding Officer’s comments: “Private First Class K_ (Applicant) is in an unsatisfactory drill status having missed and not attempted to make up 15 drills. Private First Class K_ (Applicant) joined the Marine Corps on 15 July 1998 and his unit on 19 December 1998 and has been in an unsatisfactory drill status since 4 May 2000. Private First Class K_ (Applicant) continues to show contempt towards his contractual obligations to the Marine Corps Reserve. His unwillingness to make-up missed drills and the unlikelihood of his presence at future drills make him an extreme liability to the morale and success of this unit. Private First Class K_ (Applicant) has no future mobilization potential. We mailed his letter of Notification, Acknowledgement of Rights Form and NDRB Form 13 June 2000, it was received and signed for, but SNM did not return it in time indicated. Private First Class K_ (Applicant) has no potential for future military service, he does not possess a security clearance or have access to classified material.”

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 20010202 by reason of unsatisfactory participation in the Ready Reserve (A, B, and C) with a service characterization of under other than honorable conditions. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (D and E).

The Applicant contends that he was an outstanding Marine.
When the service of a member of the U.S. Marine Corps Reserve has been honest and faithful, it is appropriate to characterize that service as honorable. An under other than honorable conditions discharge is warranted when significant negative aspects of a member’s conduct or performance of duty outweigh the positive aspects of the member’s military record. During May – June 2000, t he Applicant’s service was marred by eleven unexcused absences from scheduled drill with his reserve unit. On each of the days that the Applicant did not attend drill, his unit called his residence, for a total of 7 times, speaking to him on 4 occasions. In addition, on 3 occasions, the Applicant’s Commanding Officer notified him of his unsatisfactory drill participation via certified mail, which was received at the Applicant’s residence. Further, the Applicant received 3 retention warnings, was not recommended for promotion on 2 occasions, and was issued an administrative reduction order to Private First Class for unsatisfactory participation while a member of the Selected Marine Corps Reserve. The Applicant’s conduct, which forms the primary basis for determining the character of his service, reflects his willful failure to meet the requirements of his contract with the U.S. Marine Corps Reserve and falls far short of that required for an upgrade of his characterization of service. Relief is not warranted.

The NDRB is authorized to consider post-service factors in the recharacterization of a discharge. However, there is no law or regulation, which provides that an unfavorable discharge, may be upgraded based solely on the passage of time, or good conduct in the civilian life subsequent to leaving the service. Normally, to permit relief, a procedural impropriety or inequity must have been found to have existed during the period of enlistment in question. Outstanding post-service conduct, to the extent that such matters provide a basis for a more thorough understanding of the Applicant’s performance and conduct during the period of service under review, is considered. In his testimony the Applicant stated that he was an active member in his church and community, and that he was currently employed. The Applicant provided three letters of character reference and his fiance made a statement to the Board on his behalf. While the Board was encouraged by the Applicant’s testimony, the Applicant failed to provide verifiable proof of his post service accomplishments. As explained to
the Applicant in the response from his NDRB documentary discharge review of 20040628, the Applicant could have produced evidence of continuing educational pursuits, a verifiable employment record, documentation of community service, and certification of non-involvement with civil authorities, in order for consideration for relief based on post-service conduct. The Applicant has not provided sufficient documentation of post service character and conduct to mitigate the misconduct that resulted in his characterization of discharge. Therefore, no relief will be granted.

The following is provided for the edification of the Applicant. The Applicant has exhausted his opportunities for review by the NDRB. The Applicant may, however, petition the Board for Correction of Naval Records (BCNR), 2 Navy Annex, Washington, DC 20370-5100, concerning a change in the characterization of naval service, if he desires further review of his case.
