Applicant’s Request

The application for discharge review was received on 20050727. The Applicant requests the Discharge Characterization of Service received at the time of discharge be changed to honorable and the Narrative Reason for Separation be changed to “MEDICAL.” The Applicant requests a documentary record discharge review. The Applicant designated Department of Veterans Affairs as the representative on the DD Form 293. Subsequent to the application, the Applicant obtained representation from the Disabled American Veterans.

Decision

A documentary discharge review was conducted in Washington, D.C. on 20060403. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge and reason for discharge shall not change. The discharge shall remain as a bad conduct discharge by reason of court-marital.




PART I - APPLICANT’S ISSUES AND DOCUMENTATION

Applicant’s issues, as stated on the application:

“I’m Proud to have served my Country. Proud to be a marine special forces – My Conduct and Behavior when I got back from Desert Storm was DUE to a tottle Break Down. Looking Back I wish I could have done things different – but I was Young and inexperienced War can change you.
The War, My inability to just handles everything. No Support. Caused me to just completely Break down – I had one year left on my 4-year contract. You cant plain for a mental breakdown it just happens. I was a good solder and previous to my discharge-I had no write-ups or problems-I just snapped after the war.
I feel I deserve an honorable discharge or medical. It’s Been 12 years since my exit from the marine corps-I’ve been In and out of hospitals and in therapy the whole time-PTSD is my #1 problem along with high Anxiety- (I have 12 years of my medical files and Records). Since I got out. I’ve stayed out of trouble-know jail-know criminal file at all-I’ve Kept my nose clean-Just Mental trouble-Thanks for Your Time I deserve a second chance [signed] D_ M_(Applicant)”

“Dear Chairperson:

After a review of the Former Service Members (FSM) DD Form 293 Application for the Review of Discharge or Dismissal from the Armed Forces of the United States and all of evidence assembled for review, we continue to note the contention of the appellant in the request for a discharge upgrade of the current Bad Conduct discharge to Honorable, with the narrative reason to be changed to Medical.

The FSM served on active service from January 8, 1990 to February 13, 1995 at which time he was discharged as a result of a Court Martial (SPCM) other.

The FSM makes contentions on application and shares his belief that he was a god Marine for all purposes, until he got into a situation / Unit that required more of him intellectually than he could offer. Due to his own immaturity he chose to try and hide his inabilities instead of reporting them. This action caused a slow mental breakdown, due to the harassment by his peers, which eventually erupted into a series of mistakes and poor judgment.

As the representative, we ask that consideration be given to equitable relief, as this is a matter that involves a determination whether a discharge should be changed under the equity standards, to include any issue upon which the Applicant submits to the Board’s discretionary authority, under SECNAVIST 5420.174D.

We maintain that the current character of discharge prohibits the FSM from treatment at any VA Medical Center a General discharge would allow for equitable relief for this combat veteran, allowing him to gain access to needed medical treatment with the Department of Veterans Affairs.

We ask for the Board’s careful and sympathetic consideration of all the evidence of record used in rendering a fair and impartial decision. These issues do not supersede any issues previously submitted by the Applicant.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 19950213 with a bad conduct discharge which was the sentence adjudged by a properly convened special court-martial. That sentence was subsequently approved by both the convening and appellate review authorities (A and B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the Applicant’s issues were insufficient to merit clemency (C).


The following is for the edification of the Applicant. With respect to a discharge adjudged by a court-martial case, the action of the NDRB is restricted to upgrades based on clemency. Clemency is an act of leniency that reduces the severity of the punishment imposed. After a thorough review of the Applicant’s record, issues submitted, and post service documentation, the Board determined that clemency was not warranted and that the sentence awarded the Applicant at his court-martial was appropriate for the offenses he committed. Relief denied.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. Representation at a personal appearance hearing is recommended but not required.

Pertinent Regulation/Law (at time of discharge)

A. Paragraph 1105, DISCHARGE ADJUDGED BY SENTENCE OF COURTS-MARTIAL , of the Marine Corps Separation and Retirement Manual, (MCO P1900.16D), effective 27 Jun 89 until 17 Aug 95.

B. The Manual for Courts-Martial authorizes the award of a punitive discharge if adjudged as part of the sentence upon conviction by a special or general court-martial for violation of the UCMJ, Article 112a, wrongful use of a controlled substance.
