Applicant’s Request

The application for discharge review was received on 20050616. The Applicant requests the Discharge Characterization of Service received at the time of discharge be changed to general (under honorable conditions). The Applicant requests a personal appearance hearing discharge review before the Board in the Washington, D.C. Metropolitan area. The Applicant did not designate a representative on the DD Form 293.


Decision

A personal appearance hearing discharge review was conducted in Washington, D.C. on 20060329. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was 3 to 2 that the character of the discharge shall not change. The discharge shall remain Under Other Than Honorable Conditions by reason of misconduct due to a pattern of misconduct.

“ While I have endeavored to be of service since my discharge, its characterization as other than honorable casts a very long shadow over my life. An upgrade to general under honorable circumstances recognizes the effort I have made in the intervening 14 years to be a good parent, student, citizen, neighbor, worker and friend.”

890320:  NJP for violation of UCMJ, Article 134: During the time of Oct 88 until Nov 88 did fraternize with a Staff noncommissioned officer at StudCoA, ScolsBn, MCCES, MCAGCC.
Award: Forfeiture of $407.00 per month for 2 months, restriction and extra duty for 45 days, reduction to E-2. Reduction to E-2 suspended for a period of 6 months unless sooner vacated will be remitted without further action. Not appealed.

900418:  BAS, 1 st Radio Battalion, request for examination sent to Mental Health Clinic, Kaneohe Branch, NRMC Hawaii, Pearl Harbor, HI. Applicant request to be seen at Mental Health Clinic for counseling concerning stress and mental anguish she is experiencing because of an investigation of sexual harassment charges.
         Provisional Diagnosis: Positive anxiety disorder/adjustment disorder.

900604:  NJP for violation of UCMJ, Article 86: At 1
st RadBn, MCAS, KANHI, 1048, 900416, fail to go to Bn Aide Station.
Violation of UCMJ Article 134: At 1 st Radio Bn, MCAS, KANHI, executed a false statement “I need to go to sickbay to renew a light duty chit”, which statement did not then believe to be true.
         Award: Forfeiture of $207.00 per month for 1 month, restriction and extra duty for 14 days. Forfeiture of $207.00 is suspended for a period of 2 months, at which time, unless sooner vacated will be remitted without further action. Not appealed.

910501:  Acknowledged understanding of eligibility but not recommended for promotion to Cpl for the month of May because of poor job performance and poor attitude when working with fellow Marines in the work section. Applicant chose to make a statement.

920221:  NJP for violation of UCMJ, Article 91: Disobeyed a lawful order by a SNCO.

         Award: Forfeiture of $501.00 per month for 2 months, reduction to E-3. Appealed 920303. Appealed denied 920309.

920323:  Commanding Officer, Headquarter and Service Company, 1
st Radio Battalion, Fleet Marine Force Pacific, recommended Applicant’s discharge under other than honorable conditions due to frequent involvement with military authorities, continued pattern of misconduct and disregard for Marine Corps regulations and standards.

920417:  Counseling: Advised of deficiencies in performance and conduct (Your frequent involvement with the military authorities.), necessary corrective actions explained, sources of assistance provided, and advised being processed for administrative discharge action. Applicant chose to make a statement.

920512:  Applicant notified of intended recommendation for discharge with a characterization of service as under other than honorable conditions by reason of misconduct due to a pattern of misconduct. The factual basis for this recommendation was three nonjudicial punishments.

920512:  Applicant advised of rights and having consulted with counsel, elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation and the right to submit written statements in rebuttal to this proposed separation, in lieu of a hearing.

The investigation was completed on 26 June 1990, (enclosure 8), and it was determined that her allegations were without merit. This proposed discharge is solely based on her continuing record of misconduct.”

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 19920630 by reason of misconduct due to a pattern of misconduct (A and B) with a service characterization of under other than honorable conditions. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

The Applicant contends that “the discharge classification was disproportionately severe to the event that preceded it” and that “it ignores years of positive combat and peace time service”.
When the service of a member of the U.S. Marine Corps has been honest and faithful, it is appropriate to characterize that service as honorable. An under other than honorable conditions discharge is warranted when significant negative aspects of a member’s conduct or performance of duty outweigh the positive aspects of the member’s military record. The Applicant’s service was marred by 3 nonjudicial punishment proceedings for violations of Articles 86, 91, and 134 (3 specifications) of the UCMJ. In addition, the Applicant received a retention warning and a non-recommendation for promotion. The Applicant’s conduct, which forms the primary basis for determining the character of her service, reflects her willful failure to meet the requirements of her contract with the U.S. Marine Corps and falls far short of that required for an upgrade of her characterization of service. Relief is not warranted.

There is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service. The NDRB is authorized to consider outstanding post-service factors in the recharacterization of a discharge, to the extent that such matters provide a basis for a more thorough understanding of the Applicant’s performance and conduct during the period of service under review. During the personal appearance hearing, the Presiding Officer provided the Applicant with an opportunity to obtain additional documentation of her post-service conduct. The Applicant was given 2 weeks to provide the Board with 9 additional documents, to include a criminal records check and a copy of the letter appointing her to the Honors Board at Smith College. The Applicant did not provide all these documents. After a complete review of the entire record, including the evidence submitted by the Applicant, the Board determined that the discharge was appropriate. While the Board acknowledges the Applicant’s post-service accomplishments, the evidence of post-service conduct was found not to mitigate the conduct which precipitated the discharge. Relief denied.




The following is provided for the edification of the Applicant. The Applicant has exhausted her opportunities for review by the NDRB. The Applicant may, however, petition the Board for Correction of Naval Records (BCNR), 2 Navy Annex, Washington, DC 20370-5100, concerning a change in the characterization of naval service, if she desires further review of her case.

A. Paragraph 6210, Misconduct , of the Marine Corps Separation and Retirement Manual, ( MCO P1900.16D), effective 27 Jun 89 until 17 Aug 95.

B. The Manual for Courts-Martial authorizes the award of a punitive discharge if adjudged as part of the sentence upon conviction by a special or general court-martial for violation of the UCMJ, Article 91, willfully disobey a noncommissioned officer, Article 134 false swearing, and Article 134, public record, destroying.
