Applicant’s Request
The application for discharge review was received on 20041110. The Applicant requested the characterization of service received at the time of discharge be changed to general/under honorable conditions. The Applicant requested a documentary record review. The Applicant did not list a representative on his DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 20050118. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNCHARACTERIZED/FRAUDULENT ENTRY INTO MILITARY SERVICE, authority: MARCORSEPMAN Par. 6204.3.

 1. “I have no previous medical documentation of minor injury four years prior to entry to Marine Corp. No fraud was intended. I did not think injury was servere enough to mention. Shoulder pain only lasted two or three days and didn’t seek medical attention
Didn’t resurface until training in Marine Corp. Discarge status has kept me from obtaining an adequate employment and has severely narrowed down employment opportunities.”

040601:  Medical evaluation by the Branch Medical Clinic MCRD San Diego with Chronic Left Shoulder Impingement, EPTE; Left Shoulder muscular Atrophy, EPTE; and Left Upper Extremity Weakness, EPTE.


040604:  Commanding officer recommended separation with an uncharacterized discharge by reason of defective enlistment and induction due to a fraudulent entry into the U.S. Marine Corps. The factual basis for this recommendation was a pre-service shoulder injury, which the Applicant failed to reveal during the enlistment process.

040608:  Applicant notified of intended recommendation for separation from the Marine Corps with an uncharacterized discharge by reason of defective enlistment and induction due to a fraudulent entry into the U.S. Marine Corps.
040608:  Applicant advised of rights and having elected not to consult with counsel certified under UCMJ Article 27B, elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation.

040610:  GCMCA [Commanding General, Marine Corps Recruit Depot, San Diego] directed the Applicant's separation with an uncharacterized discharge by reason defective enlistment and induction due to a fraudulent entry into the U.S. Marine Corps.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was separated on 20040611 with an uncharacterized discharge by reason of defective enlistment and induction due to a fraudulent entry (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issue 1: By regulation, members discharged within the first 180 days of enlistment are given a service characterization of “Uncharacterized” unless there were unusual circumstances regarding performance of conduct, which would merit a different characterization. The Applicant’s service record did not contain any unusual circumstances during his less than three months in the military to warrant a change of discharge. Relief denied. The Applicant should be aware that with respect to nonservice-related administrative matters, i.e., VA benefits, civilian employment, educational pursuits, etc., an uncharacterized separation shall be considered the equivalent of an honorable or general (under honorable conditions) discharge.

The Board has no authority to upgrade a discharge for the sole purpose of enhancing employment opportunities as requested in the issue. T his issue does not serve to provide a foundation upon which the Board can grant relief. Regulations limit the Board’s review to a determination on the propriety and equity of the discharge. In the Applicant’s case, the Board discovered no impropriety or inequity; thereby, considering his discharge proper and equitable.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide additional documentation to support any claims of post-service accomplishments at that time. Representation at a personal appearance hearing is recommended but not required.
