Applicant’s Request

The application for discharge review was received on 20040810. The Applicant requests the characterization of service received at the time of discharge be changed to general/under honorable conditions. The Applicant requests a documentary record review. The Applicant did not list a representative on the DD Form 293. In the acknowledgement letter the Applicant was informed that he was approaching the 15 year point for review by this Board and was encouraged to attend a personal appearance hearing in the Washington, D. C. area. The Applicant did not respond.


Decision

A documentary record review was conducted in Washington, D.C. on 20041221. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: ENTRY LEVEL SEPARATION/Other physical/mental conditions - personality disorder, authority: NAVMILPERSMAN, Article 3620200.

1. “To be able to work in a municipal capacity as a paramedic. I have worked for the last 11 years for a private for profit service in Emergency Medical Services. I was young and immature at the time. When things didn’t go as expected I wanted out of the situation. Doing what I did at the time, I didn’t think things through.”

Chronological Listing of Significant Service Events :

891031:  Applicant diagnosed with Personality Disorder NOS and Passive-Aggressive features. The psychiatrist recommended separation based on a personality disorder of such severity as to render the Applicant incapable of serving adequately in the naval service. Applicant was considered self-destructive and a continuing risk of harm to self or others.

891102:  Applicant notified of intended recommendation for discharge with a least favorable characterization of entry level separation by reason of convenience of the government on the basis of a diagnosed personality disorder of such severity as to render the Applicant incapable of serving adequately in the naval service.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 19891116 with an entry level separation for convenience of the government on the basis of a diagnosed personality disorder of such severity as to render the Applicant incapable of serving adequately in the naval service (A and B). The Board presumed regularity in the conduct of governmental affairs (C). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (D and E).

Issue 1: T
he Board has no authority to upgrade a discharge for the sole purpose of enhancing employment opportunities. Regulations limit the Board’s review to a determination on the propriety and equity of the discharge.

The Applicant was diagnosed with a "Personality Disorder with Passive-Aggressive features" by competent medical authority, and was recommended for expeditious administrative separation from the Navy. Thus, the Board finds that the Characterization for Discharge reflects the Applicant's mental health status at the time of his discharge, and was proper and equitable at the time of issuance.

By regulation, members discharged within the first 180 days of enlistment are given the characterization of service "Entry Level Separation" unless there were unusual circumstances regarding performance or conduct. The Applicant's service record did not contain any unusual circumstances during his less than four months in the military to warrant a change in the characterization of service. The Applicant should be aware that, with respect to nonservice-related administrative matters, i.e., VA benefits, educational pursuits, and especially civilian employment, an entry level separation is considered the equivalent of an honorable or general (under honorable conditions) discharge.

The following is provided for the edification of the Applicant. The NDRB has no authority to provided additional review of this case since the Applicant’s discharge occurred more than 15 years ago. The Applicant may, however, petition the Board for Correction of Naval Records (BCNR), 2 Navy Annex, Washington, D.C. 20370-5100, concerning a change in the characterization of naval service, if he desires further review of his case.

B . NAVOP 013/87 (CNO 201614ZFEB87) Delegated authority to Special Court-Martial Convening Authorities (SPCMCA's) to administratively separate enlisted members in certain circumstances. Authority was delegated for separation of enlisted members with Honorable, General, or Entry Level discharges for the following reasons where member does not object to the separation.
