Applicant’s Request

Decision

A documentary discharge review was conducted in Washington, D.C. on 20041222. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: NAVMILPERSMAN, Article 1910 - 142 (formerly 3630605).

“When I was discharged, I was told by LN1 G_ of USS BELLEAU WOOD that after 1 yr of good behavior, my discharge would be upgrade and it hasn’t’.

I just want what was told that I would have. I volunteer for the U.S. Navy. I volunteer my life for the U.S. Navy. Unfortunately, things did go right for me in the service, but I tried. And justice will prevail. I gave my time to help the U.S. At this time I need the U.S to help me . Thank you. T_ K_ (Applicant)”

         Charge I: violation of the UCMJ, Article 92:
         Specification: Dereliction of duty on 020615, to wit: failed to stand a proper watch.
         Charge II: violation of the UCMJ, Article 128:
         Specification: Assault with means likely to cause grievous bodily harm on 020615, to wit: strike Machinist Mate Fireman T_ G. K_ in the head with stainless steel 1 inch ratchet approximately 2 feet in length and did thereby inflict grievous bodily harm upon him, to wit: tow deep cuts to the back of his head.
          Finding: to Charge I and II and the specifications thereunder, guilty.
          Sentence: Forfeiture of $762.00, confinement for 30 days.
         CA action 020701: Sentence approved and ordered executed.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 20020906 under other than honorable conditions for misconduct due to commission of a serious offense (A and B). The Board presumed regularity in the conduct of governmental affairs (C). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (D and E).

 There is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service. The NDRB is authorized to consider outstanding post-service factors in the recharacterization of a discharge, to the extent that such matters provide a basis for a more thorough understanding of the Applicant’s performance and conduct during the period of service under review. Verifiable proof of post-service accomplishments must be provided in order for the Applicant to claim post-service conduct and behavior as a reason to upgrade a less than honorable discharge. At this time, the Applicant has not provided any documentation for the Board to consider an upgrade.

When the service of a member of the U.S. Navy has been honest and faithful, it is appropriate to characterize that service as honorable. An Under Other Than Honorable Conditions discharge is warranted when significant negative aspects of a member's conduct or performance of duty outweigh the positive aspects of the member's military record. The Applicant pled guilty to charges of violating Articles 92 and 128 of the UCMJ at a summary court-martial. The Applicant’s conduct, which forms the primary basis for determining the character of his service, reflects his willful failure to meet the requirements of his contract with the U.S. Navy and falls far short of that required for an upgrade of his characterization of service. Relief is not warranted.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide documentation to support any claims of post-service accomplishments or any other evidence related to his discharge at that time. Representation at a personal appearance hearing is recommended but not required.
