Applicant’s Request
The application for discharge review was received on 20040629. The Applicant requests the characterization of service received at the time of discharge be changed to honorable. The Applicant requests a documentary record review. The Applicant did not list any representative on the DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 20050118. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER HONORABLE CONDITIONS (GENERAL)/MISCONDUCT, authority: NAVMILPERSMAN, Article 3630620.

Applicant’s issues, as stated on the application:

 1. “I was 19yrs of age at the time I was drug tested for marijuana. I was a young man away from home and both of my parents for the 1st time. I made one decision which was not a repetitive thing, but utlimately ended my career. I truly regret that one decision. Up until then I was a model shipmate and was not discipline for no other misconduct from the begining of my enlistment to the end, once agin accept for that one incident. I am no 29 years old, I have always been a good citizen in the community, I have held and currently still hold an important and respectable positions. I do not use drugs of any kind nor have I presently or in the past been a drug abuser. I humbly request for the review board to grant me the opportunity to have my General(Under Honorable Condition) be upgraded to an Honorable discharge. During these time I would like to be to contribute back to my country. This would allow me to reeinlist in a reserve unit for the Navy and amoung that recieve VA benefits. Sir or Maam’ I know it has been about 7 yrs since I’ve been in the service, but it took me this amount of time to find out how to file an appeal. Please don’t use the amount of time it took against me. I am completely sincere about this request Once again I am and have been a good citizen, a good farther, friend and son. I always took pride in my military bearing and how I conduct my self last, but not least I always took pride in the Navy.”

950726:  Drug and Alcohol Abuse Report: marijuana, not dependent, separate from service not via VA hospital. Applicant received NJP for violation of UCMJ, Article 112a: wrongful use of a controlled substance. Awarded
forfeiture of $300 per month for 2 months ($178 for 2 months suspended for 6 months), restriction and extra duty for 45 days, reduction to FA. No indication of appeal in the record.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 19960322 under honorable conditions (general) for misconduct due to drug abuse (A). After a thorough review of the available records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (B and C). The presumption of regularity of governmental affairs was applied by the Board in this case in the absence of a discharge package (D).
Issue 1. There is credible evidence in the record that the Applicant used illegal drugs. Drug abuse warranted processing for separation. Separation under these conditions generally results in characterization of service under other than honorable conditions. The evidence of record does not demonstrate that the Applicant was not responsible for his conduct or that he should not be held accountable for his actions. Relief denied.
The NDRB has no authority to change reenlistment codes or make recommendations to permit reenlistment, reentry, or reinstatement into the Naval Service or any other branch of the Armed Forces. Neither a less than fully honorable discharge nor an unfavorable “RE” code is, in itself, a bar to reenlistment. A request for waiver is normally done only during the processing of a formal application for enlistment through a recruiter.

The Veterans Administration determines eligibility for post-service benefits, not the NDRB. There is no requirement or law that grants recharacterization solely on the issue of obtaining veterans’ benefits and this issue does not serve to provide a foundation upon which the Board can grant relief.
The Applicant’s discharge characterization accurately reflects his service to his country. Normally, to permit relief, an inequity or impropriety must have existed during the period of enlistment in question. No such inequity or impropriety is evident during the Applicant’s enlistment. Additionally, there is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, to enhance employment opportunities, or for good conduct in civilian life, subsequent to leaving the service. However, the NDRB is authorized to consider outstanding post-service factors in the recharacterization of a discharge, to the extent that such matters provide a basis for a more thorough understanding of the Applicant’s performance and conduct during the period of service under review. Verifiable proof of any post-service accomplishments must be provided in order for the Applicant to claim post-service conduct and behavior as a reason to upgrade a less than honorable discharge. Evidence of continuing educational pursuits, employment record, documentation of community service, certification of non-involvement with civil authorities and credible evidence of a substance free lifestyle, are examples of verifiable documentation that may be provided to receive consideration for relief, based on post-service conduct.

The Applicant is reminded that he remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of his discharge. Representation at a personal appearance hearing is recommended but not required.
