Applicant’s Request

The application for discharge review was received on 20040601. The Applicant requests the characterization of service received at the time of discharge be changed to honorable. Decision

A documentary discharge review was conducted in Washington, D.C. on 20041113. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: GENERAL (UNDER HONORABLE CONDITIONS)/PERSONALITY DISORDER, authority: NAVMILPERSMAN, Article 1910-122 (formerly 3620225).

020628:  Branch Medical Clinic psychology evaluation: A: Diagnosis remains unchanged. P: Applicant is still recommended for an administrative separation as documented in his previous record, however, he is fully responsible for his behavior. If retained in the military he will continue to act out in immature ways.

020723:  NJP for violation of UCMJ, Article 90: Willfully disobeyed a lawful order from the commanding officer on 020628.
         Award: Forfeiture of $734 per month for 1 month, restriction and extra duty for 20 days, reduction to E-3. Restriction and extra duty suspended for 6 months. No indication of appeal in the record.

020725:  Applicant notified of intended recommendation for discharge with a general (under honorable conditions) by reason of convenience of the government on the basis of a diagnosed personality disorder of such severity as to render the Applicant incapable of serving adequately in the naval service and misconduct due to commission of a serious offense as evidenced by nonjudicial punishment on 020723 in your current enlistment.

020725:  Applicant advised of rights and having elected not to consult with counsel certified under UCMJ Article 27B, elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation.

020730:  Evaluation Record and Counseling Record: Comments: QM3 A_ (Applicant) has been unsuccessful in adjusting to the demands of sea duty. Despite continuous reinforcement, Petty Officer A_ (Applicant) has refused to contribute to the success of the Navigation Department. He refuses to perform the basic duties required of a Quartermaster at sea.
         *34, 36, 37, 38. Petty Officer A_ (Applicant) no longer desires to serve in the U.S. Navy. His intentional failure to perform his duties has forced a greater strain and workload to be shifted to other members of the Navigation Department.
         Petty Officer A_ (Applicant) is not recommended for retention in the U.S. Navy. He should be dismissed from service for his failure to honor his enlistment contract.

020801:  Commanding Officer directed discharge with a general (under honorable conditions) by reason of convenience of the government on the basis of a diagnosed personality disorder of such severity as to render the Applicant incapable of serving adequately in the naval service. Commanding Officer’s comments (verbatim): Based on review of submitted package, interviews with evaluating physicians, and a review of current manning levels in his rate, QMSN A_ (Applicant’s) administrative separation was granted.


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 20020802 with a general (under honorable conditions) for convenience of the government on the basis of a diagnosed personality disorder of such severity as to render the Applicant incapable of serving adequately in the naval service. (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issue 1.
The Applicant did not provide any documentation to overturn the presumption that he was properly diagnosed with a personality disorder. The Applicant was diagnosed with a personality disorder by a competent medical authority on 20020628. The evidence reviewed did not persuade the Board that this diagnosis and subsequent administrative separation was improper or inequitable. Relief denied.

When the service of a member of the U.S. Navy has been honest and faithful, it is appropriate to characterize that service as honorable. A General discharge is warranted when significant negative aspects of a member's conduct or performance of duty outweigh the positive aspects of the member's military record. The Applicant’s service was marred by a nonjudicial punishment proceeding for a violation of Article 90 of the UCMJ. The Applicant’s conduct, which forms the primary basis for determining the character of his service, reflects his willful failure to meet the requirements of his contract with the U.S. Navy and falls far short of that required for an upgrade of his characterization of service. Relief is not warranted.

ormally, to permit relief, a procedural impropriety or inequity must have occurred during the discharge process for the period of enlistment in question. The Board discovered no impropriety after a review of Applicant’s case. There is no law or regulation, which provides that an unfavorable discharge may be upgraded, based solely on the passage of time or good conduct in civilian life subsequent to leaving naval service. The NDRB is authorized, however, to consider post-service factors in the recharacterization of a discharge to the extent such matters provide a basis for a more thorough understanding of the applicant’s performance and conduct during the period of service under review. Examples of documentation that should be provided to the Board include proof of educational pursuits, verifiable employment records, documentation of community service, and certification of non-involvement with civil authorities. As of this time, the Applicant has not provided any documentation for the Board to consider. Relief denied.



The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide documentation to support any claims of post-service accomplishments or any other evidence related to his discharge at that time. Representation at a personal appearance hearing is recommended but not required.
