Applicant’s Request

The application for discharge review was received on 20040303. The Applicant requests the characterization of service received at the time of discharge be changed to honorable. The Applicant requests a documentary record discharge review. The Applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 20041222. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: GENERAL (UNDER HONORABLE CONDITIONS)/CONDITION, NOT A DISABILITY, authority: NAVMILPERSMAN, Article 1910-120 (formerly 3620200).

Applicant’s issues, as stated on the application:

“ I was medically discharged for somnambulism (sleepwalking) which was aggravated by stress due to new marriage, new child, wife w/severe post-partum depression and being on the wrong side of squadron office politics. I had no bad conduct issues, captain’s mast or court martial. Through out my training commands I had no problems and was a good sailor. When I arrived at Patrol Squadron Ten that perception changed though I carried on as I normally had and made an extra effort to fit in and do my duty. It is my belief that in the absence of court martial and captain’s mast my discharge should be upgraded to honorable. An honorable discharge would help me in my career endeavors. So far my general under honorable discharge has been a handicap, one that I believe is not deserved. I am not interested in any V.A. or GI Bill benefits as my time in service disqualifies me from those benefits, I’m just interested in removing this handicap so I can carry on unfettered. Thank you for time and consideration.”

Chronological Listing of Significant Service Events :

980714:  Mental Health Evaluation conducted at Naval Hospital Newport, Newport RI.
         Axis I: Occupational Problems; somnambulism.
         Axis II: Narcissistic, avoidant and obsessive/compulsive traits.
         Axis III: No diagnosis.
         Recommendation: Return to duty. Psychiatrically fit for same. No psychiatric follow-up is required. Administrative separation for somnambulism is recommended and procedure was discussed with patient [Applicant], who voice understanding.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 19981103 with a general (under honorable conditions) characterization by reason of convenience of the government, condition not a disability (A). After a thorough review of the available records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (B and C). The presumption of regularity of governmental affairs was applied by the Board in this case in the absence of a complete discharge package (D).

The Veterans Administration determines eligibility for post-service benefits not the Navy Discharge Review Board. There is no requirement or law that grants recharacterization solely on the issue of obtaining Veterans' benefits and this issue does not serve to provide a foundation upon which the Board can grant relief. Additionally, the Board has no authority to upgrade a discharge for the sole purpose of enhancing employment or educational opportunities. Regulations limit the Board’s review to a determination on the propriety and equity of the discharge.

The following is provided for the edification of the Applicant. Normally, to permit relief, a procedural impropriety or inequity must have occurred during the discharge process for the period of enlistment in question. The Board discovered no impropriety after a review of Applicant’s case. There is no law or regulation, which provides that an unfavorable discharge may be upgraded, based solely on the passage of time or good conduct in civilian life subsequent to leaving naval service. The NDRB is authorized, however, to consider post-service factors in the recharacterization of a discharge to the extent such matters provide a basis for a more thorough understanding of the applicant’s performance and conduct during the period of service under review. Examples of documentation that should be provided to the Board include proof of educational pursuits, verifiable employment records, documentation of community service, and certification of non-involvement with civil authorities. As of this time, the Applicant has not provided any documentation for the Board to consider. Relief denied.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide documentation to support any claims of post-service accomplishments or any other evidence related to his discharge at that time. Representation at a personal appearance hearing is recommended but not required.
