931213:  Civil Conviction: General District Court, Traffic Division, Norfolk, VA for violation of driving under the influence.
 Sentence: Fined $350.00 plus $26.00 court cost, jail for 90 days, license suspended for 12 months, assigned to NASAP. Jail suspended.
940126:  Drug and Alcohol Abuse Report: Marijuana abuse, ashore off duty. Unit sweep urinalysis 940126. Physician found Applicant not dependent and recommended separation. Commanding Officer recommended separation.

940214:  NJP for violation of UCMJ, Article 92: Failure to obey a lawful order, violation of UCMJ, Article 112A: Wrongfully use a controlled substance.
         Award: Forfeiture of $416.40 per month for 2 months, restriction and extra duty for 45 days. No indication of appeal in the record.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 19940701 under other than honorable conditions in lieu of a trial by court-martial (A and B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D). The presumption of regularity of governmental affairs was applied by the Board in this case in the absence of a complete discharge package (E).

Issue 1. A characterization of service of under other than honorable conditions is warranted when the member's conduct constitutes a significant departure from that expected of a sailor. T he Applicant’s service was marred by award of nonjudicial punishment and a civil conviction. While she may feel that substance abuse was a factor that contributed to her actions, the record clearly reflects her disregard for the requirements of military discipline and demonstrated that she was unfit for further service. The evidence of record does not demonstrate that the Applicant was not responsible for her conduct or that she should not be held accountable for her actions. Relief denied.

The Applicant’s discharge characterization accurately reflects her service to her country. Normally, to permit relief, an inequity or impropriety must have existed during the period of enlistment in question. No such inequity or impropriety occurred during the Applicant’s enlistment. Additionally, there is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service. Relief denied.

The Applicant is reminded that she remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of her discharge. Representation at a personal appearance hearing is recommended but not required.

B. A punitive bad conduct discharge may be adjudged for violation of the Uniform Code of Military Justice, Article 92, disobey a lawful order; and Article 112a, use of illegal drugs, upon conviction by a Special or General Court-Martial, in accordance with the Manual for Courts-Martial.
