Applicant’s Request

The application for discharge review was received on 20031218. The Applicant requests the characterization of service received at the time of discharge be changed to general/under honorable conditions. The Applicant stated he would appear before the board if needed. The Applicant did not list any representative on the DD Form 293. In the acknowledgement letter, the Applicant was informed that the Naval Discharge Review Board (NDRB) does not travel; all hearings are held in the Washington DC area. The NDRB also advised that the board first conducts a documentary review prior to any personal appearance hearing.


Decision

A documentary discharge review was conducted in Washington, D.C. on 20040910. After a thorough review of the available records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: NAVMILPERSMAN, Article 1910 - 142 (formerly 3630605).

Applicant’s issues, as stated on the application:

1. “In the first quarter of 2000 my mother passed away due to cancer. My mother was the only family that I knew of. I was given 1 week of leave. When I returned to duty on board the USS Cole (DDG-67) the ship was prepared for a six week underway period. During this time my house that had been left to me by my mother was lost due to failure to respond. The time I was in the Navy I was going through extreme stress and morning. In two years of service I made my way to E-4 and was shortly up for the E-5 Exam. I had no disceplanary issues. My mother had left me thousands of dollars in debt and my income was not near enough to pay for this. I intentually failed a drug test to get discharged from the Navy. At that time I was not fit to make any important decisions. The decision I made was a mistake and I fully apologize for my actions. At any other period in my life I strongly believe I would have been an honorary sailor. If I wouldn’t have been discharged from the navy, chances are I would have been killed on board the USS Cole and yet I wish I were there. In this review I respectfully request for my discharge to be upgraded. Thank you for your time.”

Applicant ) has always been reluctant to accept responsibility. He has difficulty adapting to changes in policy and work conditions relating to the Navy, and is unable to grasp the concept of teamwork, persistently being diverted by any number of personal interests. Petty Officer T_ ( Applicant ) is a disgrace and liability to the Naval Service.
*36/38/39 - Because of his consistent un-reliability and lack of team concept, he has created problems for his subordinates and shipmates. Additionally, Petty Officer T_ ( Applicant ) lacks the ability to handle problems at a third class Petty Officer level, and has failed to live up to Navy Core Values, Honor, Courage and Commitment. Petty Officer T_ ( Applicant ) IS NOT recommended for advancement or retention in the Armed Forces.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 20001130 under other than honorable conditions (A) for misconduct due to commission of a serious offense. After a thorough review of the available records, supporting documents, facts, and circumstances unique to this, the Board found that the discharge was proper and equitable (B and C). The presumption of regularity of governmental affairs was applied by the Board in this case in the absence of a complete discharge package (D).

Issue 1.
The Applicant contends that his problems in the Navy can be attributed to “extreme stress and morning.” In the absence of a complete discharge package, the Board presumed regularity of governmental affairs. The statements and documents provided by the Applicant do not refute the presumption of regularity in this case. The evidence of record does not demonstrate that the Applicant was not responsible for his conduct or that he should not be held accountable for his actions. Relief denied.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide documentation to support any claims of post-service accomplishments or any other evidence related to his discharge at that time. Representation at a personal appearance hearing is recommended but not required.
