Applicant’s Request

The application for discharge review was received on 20030827. The Applicant requests the characterization of service received at the time of discharge be changed to honorable. The Applicant requests a documentary record review. The Applicant did not list any representative on the DD Form 293.


Decision

A documentary review was conducted in Washington, D.C. on 20040608. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: NAVMILPERSMAN, Article 3630620.

940102:  Applicant briefed on Navy's policy of drug and alcohol abuse.

950522:  Applicant failed PRT.

960207:  Brooks AFB message reports positive urinalysis for Applicant for THC.

960304:  Medical evaluation for drug abuse found the Applicant to be a drug abuser, not drug dependent.

960306:  NJP for violation of UCMJ, Article 112A: Wrongfully use a controlled substance between 951211 and 960111, to wit: marijuana.
         Award: Forfeiture of $490.35 per month for 2 months, extra duty for 45 days, reduction to DPSA. No indication of appeal in the record.

960318:  Drug and Alcohol Abuse Report: Marijuana abuse, less than monthly, ashore off duty. Probable cause urinalysis 960111. Physician found Applicant not dependent and recommended separation. Commanding Officer recommended separation. Comments: Member tested positive for THC. SNM diagnosed not dependent by Major J_ A_, USAF on 960304. SNM has no potential for further useful service. Recommend handle per 5350.4B. Member currently receiving once a month substance abuse counseling at Kirkland AFB Medical facilities until processing for separation is completed.

960328:  Applicant notified of intended recommendation for discharge under other than honorable conditions by reason of misconduct due to drug abuse as evidenced by all incidents of drug abuse in your current enlistment.

960328:  Applicant advised of rights and having consulted with counsel certified under UCMJ Article 27B, elected to appear before an Administrative Discharge Board.

960425:  An Administrative Discharge Board, based upon a preponderance of the evidence and by unanimous vote, found that the Applicant had committed misconduct due to drug abuse, that the misconduct warranted separation, and by a vote of 2 to 1, recommended discharge under other than honorable conditions.

960429:  Commanding Officer recommended discharge under other than honorable conditions by reason of misconduct due to drug abuse (use).

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 19960529 under other than honorable conditions for misconduct due to drug abuse (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issue 1.
The Applicant states her discharge was based on one isolated incident in “29 months.” Despite a servicemember’s prior record of service, certain serious offenses, even though isolated, warrant separation from the naval service in order to maintain proper order and discipline. The Applicant’s service record is marred by award of nonjudicial punishment (NJP) for illegal drug use, thus substantiating the misconduct for which she was separated. The summary of service clearly documents that misconduct due to drug abuse was the reason the Applicant was discharged. In the Applicant’s case, the Board could discern no impropriety or inequity and therefore consider her discharge proper and equitable. Relief denied.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide documentation to support any claims of post-service accomplishments or any other evidence related to her discharge at that time. Representation at a personal appearance hearing is recommended but not required.
