Decision

A documentary discharge review was conducted in Washington, D.C. on 20040526. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: GENERAL (UNDER HONORABLE CONDITIONS)/MISCONDUCT, authority: NAVMILPERSMAN, Article 3630605.

My name is J_ L_ T_ (Applicant). I am requesting that my discharge status on my DD-214 be upgraded from general discharge under honorable conditions to honorable discharge. I know I have done wrong in the past and I am sorry for causing any trouble to you and the Navy. I want to go to school to better myself. All I am asking if you would please upgrade my discharge status. My social security number is (social number deleted). My service time was Feb. 5, 1995 to Sept. 30, 1997. I want to go to the Navy Reserve as well because I need income coming in. Please, thank you!

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 19970920 with a general (under honorable conditions) for misconduct due to commission of a serious offense (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issue 1: In the Applicant’s case, the Board could discern no impropriety or inequity and therefore considered the Applicant’s discharge proper and equitable. A characterization of service as general (under honorable conditions) is warranted when the service member’s conduct constitutes a departure from that expected of a Sailor. The Applicant’s service record is marred by award of nonjudicial punishment for violation of UCMJ, Articles 121 and 92, thus substantiating the misconduct . The Applicant’s summary of service clearly reflects the Applicant s disobedience of the orders and directives that regulate good order and discipline in the naval service, and demonstrated that she was unsuitable for further service. An upgrade to honorable would be inappropriate. Relief denied.

The Veterans Administration determines eligibility for post-service benefits not the Navy Discharge Review Board (NDRB). There is no requirement or law that grants recharacterization solely on the issue of obtaining Veteran’s benefits and this issue does not serve to provide foundation upon which the Board can grant relief.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide documentation to support any claims of post-service accomplishments or any other evidence related to her discharge at that time. Representation at a personal appearance hearing is recommended but not required.
