Applicant’s Request
The application for discharge review was received on 20030815. The Applicant requests the characterization of service received at the time of discharge be changed to honorable. The Applicant requests a documentary record discharge review. The Applicant listed the Veterans of Foreign Wars as the representative on the DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 20040921. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: GENERAL (UNDER HONORABLE CONDITIONS)/PATTERN OF MISCONDUCT, authority: NAVMILPERSMAN, Article 1910-140 (formerly 3630600).

PART I - APPLICANT’S ISSUES AND DOCUMENTATION

Applicant’s issues, as stated on the application:

1. “During the time of my discharge and the few months prior to it, my personel life was being plagued with problems. I had begun to suffer from clinical depression from which I stay medicated presently. The cause of which most likely stemmed from the deterioration of my relationship with my new wife whom I had been involved with for many years. She had left in November of 1999 and planned to return. For months I was tormented by depression and pressures of my career. After my relationship went sour and divorce became a result, my x-wife wrote an unsubstantiated letter to my C.O. stating malicious & untrue events (some). As to be expected, the superiors in my command now had the watchful eye on my life. After NJP, involving an issue of UA (for being late), my behavior became irrational & belligerent. My career & rank plummeted as a result. I will refrain from the dark times that followed my discharge from the Navy, for the embarrassment is to much to write. I have since picked my life up and moved on to finish my associates degree in Liberal Arts from ACCC of Mags Landing, N.J. It is very important to me that this matter be amended to an Honorable Discharge for I feel that though I did not complete my 4 year tour, I served it most honorably.”

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 20000804 with a general (under honorable conditions) by reason of pattern of misconduct (A). After a thorough review of the available records, supporting documents, facts, and circumstances unique to this, the Board found that the discharge was proper and equitable (B and C). The presumption of regularity of governmental affairs was applied by the Board in this case in the absence of a complete discharge package (D).

Issues 1-2. The Board’s review is limited to issues of equity and propriety. Based on the available evidence, the Board did not discern either inequity or impropriety. The Board’s presumption of regularity and the evidence of record does not demonstrate that the Applicant was not responsible for his conduct or that he should not be held accountable for his actions. Relief denied.

The following is provided for the edification of the Applicant. There is no law or regulation, which provides that an unfavorable discharge may be upgraded, based solely on the passage of time or good conduct in civilian life subsequent to leaving naval service. The NDRB is authorized, however, to consider post-service factors in the recharacterization of a discharge to the extent such matters provide a basis for a more thorough understanding of the applicant’s performance and conduct during the period of service under review. Examples of documentation that should be provided to the Board include proof of educational pursuits, verifiable employment records, documentation of community service, and certification of non-involvement with civil authorities. The Applicant’s evidence of post-service conduct was found not to mitigate his misconduct sufficient to warrant an upgrade to his discharge.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide additional documentation to support any claims of post-service accomplishments or any other evidence relating to his discharge at that time. Representation at a personal appearance hearing is recommended but not required.
