Applicant’s Request

The application for discharge review was received on 20030707. The Applicant requests the characterization of service received at the time of discharge be changed to general/under honorable conditions. The Applicant requests a documentary record review. The Applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 20040514. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNCHARACTERIZED (ENTRY LEVEL SEPARATION)/ERRONEOUS ENTRY (OTHER), authority: NAVMILPERSMAN, Article 1910-130 (formerly Article 3620280).

The NDRB did note administrative error(s) on the original DD Form 214. Block 25, Separation Authority, should read: "NAVMILPERSMAN, Article 1910-130" vice "MILPERSMAN 3630380 CO RTC LTR 1910 SER 10/2576 OF 18MAY98." The Commander, Naval Personnel Command, Millington, TN, will be notified, recommending the DD Form 214 be corrected or reissued, as appropriate.

1. “I L_ W_ (Applicant) ask for a change of my RE code which is a 4 to a 3 so I may be allow to join the service again. I was discharge from the Navy after failing battlestation 2 twice I felt that I couldn’t try again and for that I say I couldn’t adjust and to this environment now looking back I know that was the worst mistake of my life so know I hear asking you to allow me a second chance because I know my place is in the U.S Army or Navy. I’ve always wanted to be in the military. So by me being a little older, wiser I know without a doubt I can be one of your soldiers. Please allow me this chance if you only know how much I want this and have beening tring to get back in the service you see that this is where I belong.”

980514:  Recruit Mental Health evaluation:

         1. Entry level separation is effected because of the disqualifying psychiatric condition.
         2. SR was encouraged to seek treatment for their condition upon separation. SR was educated regarding this condition and given an after care referral. SR is suitable to report to separation division.

980515:  Applicant notified of intended recommendation for discharge with a general (under honorable conditions) by reason of convenience of the government as evidenced by an adjustment disorder.

980515:  Applicant advised of rights and having elected not to consult with counsel certified under UCMJ Article 27B, elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation.

980518:  Commanding Officer directed discharge with an uncharacterized service by reason of defective enlistment and induction due to erroneous enlistment.


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 19980521 with an uncharacterized service for defective enlistment and induction due to erroneous enlistment (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issue 1: By regulation, members discharged within the first 180 days of enlistment are given characterization of services as “Uncharacterized” unless there were unusual circumstances regarding performance of conduct which would merit an “honorable” characterization. The Applicant’s service record did not contain any unusual circumstances during her less than three months in the military to warrant a change of discharge to “honorable.”
Relief denied. The Applicant should be aware that, with respect to nonservice-related administrative matters, i.e., VA benefits, civilian employment, educational pursuits, etc., an uncharacterized separation is considered the equivalent of an honorable or general (under honorable conditions) discharge.

Concerning a change in reenlistment code, the NDRB has no authority to change reenlistment codes or make recommendations to permit reenlistment, reentry, or reinstatement into the Naval Service or any other branch of the Armed Forces. Neither a less than fully honorable discharge nor an unfavorable “RE” code is, in itself, a bar to reenlistment. A request for waiver is normally done only during the processing of a formal application for enlistment through a recruiter.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide documentation to support any claims of post-service accomplishments or any other evidence related to her discharge at that time. Representation at a personal appearance hearing is recommended but not required.
