Applicant’s Request

The application for discharge review was received on 20030612. The Applicant requests the characterization of service received at the time of discharge be changed to general/under honorable conditions. Decision

A documentary discharge review was conducted in Washington, D.C. on 20040504. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: NAVMILPERSMAN, Article 1910-146, formerly Article 3630620.

Applicant’s issues, as stated on the application:

1. “My discharge was inequitable because it was based on one isolated incident in 13 months of service with no other adverse action. I informed the Master At Arms that I used the substance, because of a lot of stress due to family reasons back home in Chicago. My big brother lost all 6 of his kids and my mom was calling home and crying to me everyday. Everything hit me at one time because I was at home with my wife and daughter going through my own problems, because I was at work so much. The Master At Arms said that my THC level was so low that if I would have taken the test the next day, I wouldn’t have failed the test. I’ve never used a drug since that day. I currently can’t find a job because of my discharge and now I’m going through a divorce and losing my family. I’m going through a lot of problems because of my one mistake. I wish I could rejoin the Navy or at least get a job. I have a Bachelors Degree in Speech Communication, and now I’m sitting at home losing everything. I love my wife and daughter very much, but with me getting discharged my wife is leaving. Also, I wanted to ask if I did get a chance to enter the Navy again, could I go to Officers School. Ever since I entered the Navy, Chiefs and Petty Officers have been telling me that my recruiter shout have put one in OCS because of my degree. I do apologize for my action and appreciate your time.          Award: Forfeiture of $644 per month for 2 months, restriction and extra duty for 45 days, reduction to AOAA. No indication of appeal in the record.

021108:  Applicant notified of intended recommendation for discharge under other than honorable conditions by reason of misconduct due to drug abuse.

021108:  Applicant advised of rights and having elected not to consult with counsel certified under UCMJ Article 27B, elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation.

021207:  Commanding Officer recommended discharge under other than honorable conditions by reason of misconduct due to drug abuse (use).

021213:  Commander, Cruiser-Destroyer Group EIGHT directed the Applicant's discharge under other than honorable conditions by reason of misconduct due to drug abuse (use).


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 20021215 under other than honorable conditions for misconduct due to drug abuse (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issues 1-2: Normally, to permit relief, an error or injustice must have existed during the period of enlistment in question. No such error or injustice occurred during the Applicant’s enlistment. While he may feel that his family problems were contributing factors, they do not mitigate the Applicant’s disobedience of the orders and directives that regulate good order and discipline in the naval service, demonstrating he was unsuitable for further service. His service record is marred by award of nonjudicial punishment (NJP) for drug abuse thus substantiating the misconduct
. Relief denied.

There is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service. However, the NDRB is authorized to consider outstanding post-service factors in the recharacterization of a discharge, to the extent that such matters provide a basis for a more thorough understanding of the Applicant’s performance and conduct during the period of service under review. Verifiable proof of any post-service accomplishments must be provided in order for the Applicant to claim post-service conduct and behavior as a reason to upgrade a less than honorable discharge. E
vidence of continuing educational pursuits, a positive employment record, a drug free lifestyle, and certification of community service and non-involvement with civil authorities are examples of verifiable proof that can be submitted. At this time, the Board determined that the documentation submitted by the Applicant does not mitigate his misconduct while on active duty

The NDRB has no authority to change reenlistment codes or make recommendations to permit reenlistment, reentry, or reinstatement into the Naval Service or any other branch of the Armed Forces. Neither a less than fully honorable discharge nor an unfavorable “RE” code is, in itself, a bar to reenlistment. A request for waiver is normally done only during the processing of a formal application for enlistment through a recruiter.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide documentation to support any claims of post-service accomplishments or any other evidence related to his discharge at that time. Representation at a personal appearance hearing is recommended but not required.
