Applicant’s Request

The application for discharge review was received on 20030516. The Applicant requests the characterization of service received at the time of discharge be changed to honorable. The Applicant requests a documentary record review. The Applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 20040423. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/IN LIEU OF TRIAL BY COURT MARTIAL, authority: NAVMILPERSMAN, Article 1910-106 (formerly 3630650).


PART I - APPLICANT’S ISSUES AND DOCUMENTATION

Applicant’s issues, as stated on the application:

“1. I am D___ J K___, An Indian Native came to America by Green Care on 08/01/1998. After a month or so, I met a Recruiter in Oklahoma City, Oklahoma. He told me great deals about U S Navy and promised me to give me the job of my preference. While and after Boot Camp, I came to know, I won’t be getting any job of my preference and I can only be undesignated because of my place of origin and the length of contract I signed for the service. I felt like I was being betrayed because I was not here in this Country not even for 3 months before I went to Boot Camp. I was affected very much mentally. I cried almost every day and I had some loss of memory. On the other hand, my Grandfather was very sick and he was in the hospital back in India for a long period of time. Doctors told that his life is coming to an end. So, I tried many ways to apply for a long leave of absence for more than six months. But I was not approved. So I decided to leave by myself because family is very important than anything for me, that’s how I grew up and I was so stressed at that time.
When I came from India, I was thinking to turn myself in to the military personnel. But it was too late. I was being apprehended by the airport authorities as soon as I came out of the Airplane. They sent me to the county prison and from there I was sent to the Military Brig As far as Military is concerned, it’s quite obvious that someone to leave for long period of time is a crime. But regret for that because of my stressfulness. Later I did not appear for the Court Martial because I plead guilty for Unauthorized Absence for which they charged me and I got out with Other than Honorable Discharge. Whenever I think about my military experience, makes me scare. But personally, I am an honorable person and I am proud to be in the land of free. Actually I like America, so I joined Military here. But I feel very bad because of my type of Discharge. I am being turned down in so many places and I am going to be turned down by the INS for my Citizenship whereas the other people with Greencard who did not serve in the Military getting their Citizenship by the completion of 5 years in America as soon as they apply. Please consider my hardship which I gone through and please upgrade my Discharge to Honorable Discharge, so that I can start a new life.

001005:  Report of Return of Deserter. Applicant apprehended by civil authorities on 000929 (2230) at San Francisco, CA. Returned to military control 000930 (0110). Delivered to TPU San Diego, CA.

001109:  Charges preferred to special court-martial for violation of the Uniform Code of Military Justice (UCMJ) Article 86: Unauthorized absence from 000225 to 000930 and 000218 to 000222.

001114:  Applicant
requested an administrative discharge under other than honorable conditions in lieu of a trial by court-martial. He consulted with counsel and was fully advised of the implications of his request. The Applicant stated he understood the elements of the offenses with which he was charged, and admitted he was guilty of all the charges preferred against him. Specifically, he admitted to violating UCMJ, Article 86: Unauthorized absence. The Applicant stated he was completely satisfied with the counsel he had received. The Applicant understood that if discharged under other than honorable conditions, it might deprive him of virtually all veterans' benefits based upon his current enlistment, and that he might expect to encounter substantial prejudice in civilian life in situations wherein the type of service rendered or the character of discharge received therefrom may have a bearing.

001121:  The Commanding Officer, exercising GCMCA, approved the request for an administrative separation in lieu of a trial by court-martial, and directed Applicant’s discharge.


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 20001204 under other than honorable conditions in lieu of a trial by court-martial (A and B). The Board presumed regularity in the conduct of governmental affairs (C). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (D and E).

Issue 1: A characterization of service of under other than honorable conditions is warranted when the member’s conduct constitutes a significant departure from that expected of a Sailor. In a signed statement, the Applicant requested an administrative discharge under other than honorable in lieu of a trial by court-martial. He consulted with counsel and was fully advised of the implications of his request. The Applicant understood that if discharged under other than honorable conditions, it might deprive him of virtually all veteran’s benefits based upon his current enlistment. He also understood he might encounter substantial prejudice in civilian life in situations wherein the type of service rendered or the character of discharge received therefrom may have a bearing. The Applicant stated he understood the elements of the offenses with which he was charged. He admitted he was guilty of violating Article 86: unauthorized absence. Relief denied.

There is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service. However, the NDRB is authorized to consider outstanding post-service factors in the recharacterization of a discharge, to the extent that such matters provide a basis for a more thorough understanding of the Applicant’s performance and conduct during the period of service under review. Verifiable proof of any post-service accomplishments must be provided in order for the Applicant to claim post-service conduct and behavior as a reason to upgrade a less than honorable discharge. Evidence of continuing educational pursuits, a positive employment record, and certification of community service and non-involvement with civil authorities are examples of verifiable proof that can be submitted.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide additional documentation to support any claims of post-service accomplishments at that time. Representation at a personal appearance hearing is recommended but not required.
