Applicant’s Request

The application for discharge review, received 20030107, requested that the characterization of service on the discharge be changed to honorable and the reason for the discharge be changed to Secretarial Authority or Completion of Required Service. The Applicant requested a personal appearance hearing before the board in the Washington National Capital Region. The Applicant listed a civilian attorney as the representative on the DD Form 293.


Decision

A personal appearance hearing was conducted in Washington, D.C. on 20031023. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, an inequity in the reason for discharge and subsequent characterization of the Applicant’s service was discovered by the NDRB. The Board determined that relief was warranted on the basis of equity. The Board’s vote was three to two that the character of the discharge and the narrative reason for the discharge will change. The discharge shall change to HONORABLE/SECRETARIAL AUTHORITY, authority: NAVMILPERSMAN, Article 3630900, Separation Code of JFF

“1. Equity : Whether the applicant’s post-service conduct, including successfully applying for, enlisting and completing required service in the National Guard and subsequently being accepted into National Guard OCS, provides a sufficient basis to merit upgrade.

2.
Propriety : Whether the adverse separation action was improper due to the fact that, of the two accusers against the applicant during nonjudicial punishment proceedings and the subsequent adverse board action, one recounted his accusations under oath and there was no corroboration of the second individual’s identification of the applicant during a tape recorded sting operation transcribed and included as an enclosure to the original DRB petition.”

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 20000905 with a characterization of general (under honorable conditions) for misconduct due to drug abuse (use) (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper but inequitable (C and D) at the time of discharge.

In the course of reviewing the Applicant’ service record, transcript of the administrative discharge board, and the Applicant’s testimony, the Board found, by a vote of 3 to 2, that the evidence of record did not support the Applicant’s administrative separation for drug abuse. Applicant's separation for this reason was, therefore, determined to be inequitable. Relief is therefore granted.
