Applicant’s Request

The application for discharge review, received 20021121, requested that the characterization of service on the discharge be changed to honorable or general/under honorable conditions. The Applicant requested a personal appearance hearing before the board in the Washington National Capital Region. The Applicant did not list any representative on the DD Form 293. Subsequent to the application, the Applicant obtained representation by the American Legion.

Decision

A personal appearance hearing was conducted in Washington, D.C. on 20030917. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Applicant’s post-service accomplishments were extensive and commendable. However, they were not sufficient to mitigate the extent of his in service drug use and fell short of that required for relief. The Board’s vote was three to two that the character of the discharge shall not change. The Board was unanimous that the narrative reason for the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: NAVMILPERSMAN, Article 3630620.

910704:  Applicant reenlisted for 4 years.

930108:  Drug and Alcohol Abuse Report: Cocaine abuse, ashore off duty. Abuse denied. Random urinalysis 921120. CAAC found the Applicant not dependent and recommended separation. Commanding Officer recommended separation. Comments: Petty Officer (Applicant’s) record of performance at NRD Kansas City was that of a 4.0 sailor. Fleet evaluations reflected much the same. Due to his conviction at a Special Courts Martial for use of a prohibited substance (cocaine) Petty Officer (Applicant) is being processed for separation from the Navy and is not recommended for continued service.

930204:  Special Court Martial
         Charge I: violation of the UCMJ, Article 112A:
         Specification 1: Wrongful use of a controlled substance between 921110 and 921120, to wit: cocaine.
         Findings: to Charge I and specifications 1 hereunder, guilty.
         Sentence: Confinement for 45 days, reduction to AD2.
         CA 930609: Sentence approved and ordered executed.

930617:  Applicant notified of intended recommendation for discharge under other than honorable conditions by reason of misconduct due to drug abuse.

930617:  Applicant advised of his rights and having consulted with counsel certified under UCMJ Article 27B, elected to appear before an Administrative Discharge Board.

930708:  An Administrative Discharge Board, based upon preponderance of the evidence and by unanimous vote, found that the Applicant had committed misconduct due to drug abuse, that the misconduct warranted separation, and recommended discharge under other than honorable conditions.

930709:  Medical evaluation for drug abuse found the Applicant to be a drug abuser, not drug dependent.

930805:  Commanding Officer recommended discharge under other than honorable conditions by reason of misconduct due to drug abuse (use).

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 19931008 under other than honorable conditions for misconduct due to drug abuse (use) (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issue 1: T here is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service. However, the NDRB is authorized to consider outstanding post-service factors in the recharacterization of a discharge, to the extent that such matters provide a basis for a more thorough understanding of the Applicant’s performance and conduct during the period of service under review. Verifiable proof of any post-service accomplishments must be provided in order for the Applicant to claim post-service conduct and behavior as a reason to upgrade a less than honorable discharge. Evidence of continuing educational pursuits, a positive employment record, a drug-free lifestyle, and certification of community service and non-involvement with civil authorities are examples of verifiable proof that can be submitted. The Board greatly appreciates the Applicant’s efforts to continue his education and his involvement in the drug rehabilitation of inmates and encourages him to continue his participation. However, the Applicant did not provide sufficient verifiable documentation of good character and conduct to mitigate his special court-martial conviction for illegal drug use. Relief is not warranted. However, the NDRB did note an administrative error on the original DD Form 214 and corrected it to reflect the Applicant’s previous thirteen years of honorable service.
