Applicant’s Request

The application for discharge review, received 20020925, requested that the characterization of service on the discharge be changed to honorable. The Applicant requested a personal appearance discharge review before a traveling panel closest to (left blank). The Applicant did not list any representative on the DD Form 293. In the acknowledgement letter to the Applicant, was informed that the Naval Discharge Review Board (NDRB) does not travel; all hearings are held in the Washington DC area. The NDRB also advised that the board first conducts a documentary review prior to any personal appearance hearing.


Decision

A documentary discharge review was conducted in Washington, D.C. on 20030812. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the Applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: NAVMILPERSMAN, Article 1910-146, formerly Article 3630620.


PART I - APPLICANT’S ISSUES AND DOCUMENTATION

Issues, as submitted (verbatim)

1. First off I would like to thank the board for listening. The discharge I received was a OTH (other than honorable). It was given to me for the usage of an illegal drug (marijuana). At the time I was being careless and disrespectful to my command and knowing now my country. I feel I deserve a second chance I prove to my family, friend, US. Government and the country I live in that I'm not the same 19 yrs old that was on his own and couldn't handle become a man, but one willing and able to follow directions and orders. The reason I feel that I broke the no drug law was I become friends some E-4's and E-5's who told me I that it would be okay if you take these pills or drink this tea. I thought if these guys haven't got caught I won't neither. A year has past and I've gone to Re-Hab class at Kingwood Hospital in Detroit, MI. I have a two year son an I ready to be of service the best job an choice I ever made and let go of the things that about to this letter. Thank you.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 20010531 under other than honorable conditions for misconduct due to drug abuse (use) (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

In the Applicant’s issue 1, the Board determined this issue has no merit. The Applicant requests a second chance to prove he is not the same 19 year old that served in the military.
Normally, to permit relief, an error or inequity must have existed during the period of enlistment in question. No such error occurred in this case. The NDRB is authorized to consider post-service factors in the recharacterization of a discharge. However, there is no law or regulation, which provides that an unfavorable discharge may be upgraded, based solely on the passage of time, or good conduct in the civilian life subsequent to leaving the service. Outstanding post-service conduct, to the extent that such matters provide a basis for a more thorough understanding of the applicant's performance and conduct during the period of service under review can be considered. Examples include documentation such as educational pursuits, verifiable employment record(s), documentation of community service, certification of non-involvement with civil authorities, and credible evidence of a substance free lifestyle. At this time, the applicant has not provided any documentation for the Board to consider. Therefore, no relief will be granted.

The applicant
is reminded that he is eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of his discharge. The applicant can provide additional documentation to support any claims of post-service accomplishments at that time. Representation at personal appearance hearing is recommended but not required.
