Applicant’s Request
The application for discharge review was received on 20030708. The Applicant requests the characterization of service received at the time of discharge be changed to honorable. The Applicant requests a documentary record review. The Applicant did not list any representative on the DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 20040430. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: MARCORSEPMAN 6210.5.

“1. I am requesting an upgrade in my discharge. My discharge was based on a single event that occurred in the service. I was having emotional problems that were caused by my ex-wife. Prior to this event I was a good Marine. I received letters of appreciation, graduated from several military schools. I believe that I was wrongfully giving an incorrect discharge. This has affected me harshly because one incident has ruined my life and military career.”

 Chronological Listing of Significant Service Events :

980928:  NAVDRUGLAB Jacksonville, FL, reported Applicant’s urine sample, received 980918, tested positive for cocaine.

981022:  Medical evaluation for drug abuse found the Applicant psychologically fit for duty and returned to same, found not dependent, recommended for separation.

981117:  Summary Court-Martial.
         Charge I: violation of the UCMJ, Article 112a: Did at unknown location between on or about 980905, and on or about 980915, wrongfully use cocaine.
         Finding: to Charge I and the specification thereunder, guilty.
         Sentence: Forfeiture of $463.00 pay per month for 1 month, reduced to E-1, confinement to 10 days.
         CA action 981117: Confinement for 10 days is hereby suspended for a period of 10 days. The sentence as adjudged is approved and ordered executed.

981117:  Applicant notified of intended recommendation for discharge under other than honorable conditions by reason of misconduct due to drug abuse.
981117:  Applicant advised of rights and having elected to consult with counsel certified under UCMJ Article 27B, elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation.

981118:  Commanding officer recommended discharge under other than honorable conditions by reason of misconduct due to drug abuse. The factual basis for this recommendation was the respondent’s incident of illegal drug use as identified in NAVDRUGLAB JACKSONVILLE FL msg 282033Z Sep 98.

981123:  SJA review determined the case sufficient in law and fact.

981124:  GCMCA [Commanding General] directed the Applicant's discharge under other than honorable conditions by reason of misconduct due to drug abuse.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 19981125 under other than honorable conditions for misconduct due to drug abuse (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issue 1. The Applicant states his discharge was based on one single event in his service.
Despite a servicemember’s prior record of service, certain serious offenses, even though isolated, warrant separation from the naval service in order to maintain proper order and discipline. Mandatory processing for separation is required for Marines who abuse illegal drugs. Separation under these conditions generally results in characterization of service under other than honorable conditions. The evidence of record does not demonstrate that the Applicant was not responsible for his conduct or that he should not be held accountable for his actions. In the Applicant’s case, the Board could discern no impropriety or inequity and therefore consider his discharge proper and equitable. Relief denied.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide documentation to support any claims of post-service accomplishments or any other evidence related to his discharge at that time. Representation at a personal appearance hearing is recommended but not required.
