Applicant’s Request

The application for discharge review, received 20021028, requested that the characterization of service on the discharge be changed to honorable and the reason for the discharge be changed to convenience of the government. The Applicant requested a documentary record discharge review. The Applicant did not list any representative on the DD Form 293. In the acknowledgement letter, the Applicant was informed that he was approaching the 15 year point for review by this Board and was encouraged to attend a personal appearance hearing in the Washington, D.C. area. Applicant did not respond.


Decision

A documentary discharge review was conducted in Washington, D.C. on 20030926. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character and narrative reason of the discharge shall not change. The discharge shall remain: UNDER CONDITIONS OTHER THAN HONORABLE/Separation in lieu of trial by court-martial, authority: MARCORSEPMAN Par. 6419.


ART I - APPLICANT’S ISSUES AND DOCUMENTATION


Issues, as submitted

1. My discharge was based upon the conduct over an 8 month period, during which time I received a knee injury & became addicted to pain-killers & later other narcotics. I informally spoke with my Btn, Sgt Maj, he stated that it was my problem, & not the Marine Corps, to get fixed. I was UA on several occasions due to my drug problem. Eventually I was given the choice of discharge in lieu of court martial. I was young at the time and didn’t fully appreciate the significance such a discharge would have on my life. Upon discharge I completed 2 residential drug treatment programs, I was habitat, which is a 2 yrs. Program, the 2 nd was Salvation Army which was 6 months & aftercare. I have been clean since 1989, and I obtained 2 college certifications. One as a computer repair tech, & the 2 nd as an automotive service tech. I am finding it difficult to obtain loans or a respectable job due to the type of discharge I have. I pray that you will reconsider the type of discharge that I have, & grant me an upgrade in my discharge status.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 19880923 under conditions other than honorable in lieu of trial by court-martial (A and B). The Board presumed regularity in the conduct of governmental affairs (C). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (D and E).

Issue 1. The Applicant’s discharge proceedings are not available for review. The Applicant did not provide sufficient documentation to refute the presumption of regularity in this case. No other narrative reason is presumed to more clearly describe the circumstances surrounding the Applicant’s processing for administrative separation.
Normally, to permit relief, an error or inequity must have existed during the period of enlistment in question. No such error or inequity is evident during the Applicant’s enlistment. Additionally, there is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, to enhance employment opportunities, or for good conduct in civilian life, subsequent to leaving the service. However, the NDRB is authorized to consider outstanding post-service factors in the recharacterization of a discharge, to the extent that such matters provide a basis for a more thorough understanding of the Applicant’s performance and conduct during the period of service under review. Verifiable proof of any post-service accomplishments must be provided in order for the Applicant to claim post-service conduct and behavior as a reason to upgrade a less than Honorable discharge. Evidence of continuing educational pursuits, employment record, documentation of community service, certification of non-involvement with civil authorities and credible evidence of a substance free lifestyle, are examples of verifiable documentation that should have been provided to receive consideration for relief, based on post-service conduct. The Applicant’s evidence of post-service conduct was found not to mitigate the offense for which he was discharged. Relief not warranted.

A. Paragraph 6419, SEPARATION IN LIEU OF TRIAL BY COURT-MARTIAL, of the Marine Corps Separation and Retirement Manual, (MCO P1900.16C), Change 2, effective 15 May 84 until 26 Jun 89.

B. The Manual for Courts-Martial authorizes the award of a punitive discharge if adjudged as part of the sentence upon conviction by a special or general court-martial for violation of the UCMJ, Article 86, unauthorized absence.
