Applicant’s Request

The application for discharge review, received 020806, requested that the characterization of service on the discharge be changed to honorable. The Applicant requested a documentary record discharge review. The Applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 030501. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the Applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: GENERAL (UNDER HONORABLE CONDITIONS)/MISCONDUCT, authority: NAVMILPERSMAN, Article 1910 - 142 (formerly 3630605).

Issues

1. I believe my punishment did not have to go to extreme measures. Right now, it's important for me to change my discharge to honorable, so it will be a lot easier for me to be employed. I am not working at the moment, but I'm attending college, and so I need to work, so I may be able to pay for my college classes. Right now, I wish to live my life normally without any concerns of my Naval record. By having my discharge change to an honorable, I will be able to find employment, without the concern of employment investigation of records. I'd be really thankful for the consideration of this. Thank you for time in reading this.

Chronological Listing of Significant Service Events :

991105:  Applicant acknowledged receiving training on USS RAINER's computer and Internet usage policy. Applicant agreed to adhere with current Department of Defense policy. Applicant acknowledged that noncompliance with policy is regarded of evidence of irresponsibility and could result in administrative/disciplinary actions.

010928:  NJP for violation of UCMJ, Article 92: Failed to obey a lawful general regulation, to wit: Joint Ethics Regulations dated 960325 by viewing inappropriate material on a federal government communications system.
         Award: Forfeiture of $585 per month for 2 months, restriction for 60 days, reduction to SA. No indication of appeal in the record.

011002:  Applicant notified of intended recommendation for discharge general (under honorable conditions) by reason of misconduct due to the commission of a serious offense.

011002:  Applicant advised of his rights and having elected not to consult with counsel certified under UCMJ Article 27B, elected to waive all rights.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 011004 general (under honorable conditions) for misconduct due to commission of a serious offense (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

The Applicant requested that the NDRB review his discharge and consider an upgrade in order to help him obtain employment. The Board, under its responsibility to examine the propriety and equity of an Applicant's discharge, will change the characterization and/or the reason for discharge if
an error or inequity exists within the separation process. The Board found that no such error or inequity occurred during that time and that the Applicant’s discharge characterization accurately reflects his service to his country. Relief on this basis is denied .

The following is provided for the edification of the Applicant. There is no law or regulation that provides for an unfavorable discharge to be upgraded based solely on the passage of time or good conduct in civilian life subsequent to leaving the service. The NDRB is authorized, however, to consider outstanding post-service factors in the recharacterization of a discharge to the extent that such matters provide a basis for a more thorough understanding of the Applicant’s performance and conduct during the period of service under review. Verifiable proof of post-service accomplishments must be provided in order for the Applicant to claim post-service conduct and behavior as a reason to upgrade a less than honorable discharge. E vidence of continuing educational pursuits, an employment record, and documentation of community service are examples of verifiable documents that may be provided to receive consideration for relief based on post-service conduct. At this time, the Applicant has not provided sufficient such documentation for the Board to consider.

The Applicant is reminded that he remains eligible for a personal appearance hearing, provided an application is received at the NDRB within 15 years from the date of his discharge. The Applicant can provide additional documentation to support any claims of post-service accomplishments at that time. Representation at a personal appearance hearing is recommended but not required.
