Applicant’s Request

The application for discharge review, received 020530, requested that the characterization of service on the discharge be changed to honorable. The Applicant requested a documentary record discharge review. The Applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 030221. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety but did discern an inequity in the characterization of the Applicant’s service. The Board’s vote was unanimous that the character of the discharge shall change. The discharge shall change to: HONORABLE/PERSONALITY DISORDER, authority: NAVMILPERSMAN, Article 3620225.



PART I - APPLICANT’S ISSUES AND DOCUMENTATION

Issues, as submitted

1. That I deserve a discharge which could enable me to access my Educational Benefits.

2. My military Educational courses were not included on my DD 214.

3. My peers made life unbearable for me in the Navy. That one of these was sent to Captain's Mass.

4. One of them was always using expletive remark in addressing me.

5. The came a point in time that I started to fear for my life. So I request to be discharge.

6. The medical officer on board Mr. J_ A_ positively told me - unless he profess to say that I am on the verge of hurting myself, They will not let me go.

7. That I have never fall foul of the law both in civil and military life hitherto.

Chronological Listing of Significant Service Events :

970724:  Applicant diagnosed with adjustment disorder with depressed mood, avoidant personality disorder. The psychiatrist recommended separation based on a personality disorder of such severity as to render the Applicant incapable of serving adequately in the naval service. Applicant was considered self-destructive and a continuing risk of harm to self or others.


970731:  Applicant notified of intended recommendation for discharge under honorable conditions (general) by reason of convenience of the government on the basis of a diagnosed personality disorder of such severity as to render the Applicant incapable of serving adequately in the naval service as evidenced by psychiatric evaluation of 24 July 1997.

970731:  Applicant advised of rights and having elected not to consult with counsel certified under UCMJ Article 27B, elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation.

970824:  Commanding Officer directed discharge under honorable conditions (general) by reason of convenience of the government on the basis of a diagnosed personality disorder of such severity as to render the Applicant incapable of serving adequately in the naval service.


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 970818 under honorable conditions (general) for convenience of the government on the basis of a diagnosed personality disorder of such severity as to render the Applicant incapable of serving adequately in the naval service. (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper but not equitable (C and D).

Issue 1. The Veterans Administration determines eligibility for post-service benefits, not the NDRB. There is no requirement or law that grants recharacterization solely on the issue of obtaining veterans’ benefits and this issue does not serve to provide a foundation upon which the Board can grant relief.

Issue 2. Recommended corrections to the Applicant’s DD Form 214 are listed on page one of this document. Formal training courses other than those currently listed on Block 14 were not found. Therefore, the Board did not recommend any additions to Block 14.

Issue 3-7. The Board found that in the Applicant’s case, the characterization of service should have been the “type warranted by service record.” A review of Applicant’s records indicated an honorable discharge was warranted. Applicant’s performance and behavior marks were above the standard required for an honorable discharge and there was no adverse information that would have warranted a less favorable characterization. Therefore, relief is granted.
