Applicant’s Request

The application for discharge review, received 020402, requested that the characterization of service on the discharge be changed to honorable. The Applicant requested a documentary record discharge review. The Applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 030107. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the Applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: GENERAL (UNDER HONORABLE CONDITIONS)/MISCONDUCT, authority: NAVMILPERSMAN, Article 1910-146, formerly Article 3630620.



PART I - APPLICANT’S ISSUES AND DOCUMENTATION

Issues, as submitted

1. My reason(s) for submitting this letter to Naval Council of Personnel Boards is to first, thank you for allowing me to voice an apology to the United States Military. This is in regards to my non-completion of my 4-year contract. Second, to ask for re-entry status to the United States Navy. My initial enlistment was April 14, 2000, to March 17, 2001. Following "Boot Camp", orders were giving to serve aboard USS WADSWORTH FFG-9, San Diego, California. Along with my superiors as a Yeoman Seaman Recruit, I put forth all efforts to prepare, update, and assist all fleeter administrative needs aboard our command. During this time, family financial issue(s) back home became unavoidable, and needed my attention immediately. But despite all documents supplied, which were required by MILPERSMAN, for dependant care assistance. I could never get dependant assistance awarded to me. This became a major stress issue, which led to my dismissal for misconduct. Which I whole-heartedly regret. Please accept my apologies. All matters are situated at this time, and if allowed would be grateful, to be considered for upgrade and re-entry into the United States Navy, to serve as I was once selected to serve. Sincerely

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 010330 with a discharge characterization of general (under honorable conditions) for misconduct due to drug abuse (use) (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issue 1: Drug abuse warranted processing for separation, normally under other than honorable conditions. The Applicant s service record is marred by award of non-judicial punishment for the wrongful use of a controlled substance. The record is devoid of evidence that the Applicant was not responsible for his conduct or that he should not be held accountable for his actions. Furthermore, the Applicant’s misconduct reflects his disregard for the Navy s Zero Tolerance Policy on drug use and demonstrated he was unsuitable for further service. Relief denied.

Issue 2: Concerning a change in reenlistment code, the NDRB has no authority to change reenlistment codes or make recommendations to permit reenlistment, reentry, or reinstatement into the Naval Service or any other branch of the Armed Forces. Neither a less than fully honorable discharge nor an unfavorable “RE” code is, in itself, a bar to reenlistment. A request for waiver is normally done only during the processing of a formal application for enlistment through a recruiter. Relief is therefore denied.

The following information is provided for the benefit of the Applicant. Normally, to permit relief, an error or injustice must have existed during the period of enlistment in question. No such error or injustice occurred during the Applicant’s enlistment. Additionally, there is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service. However, the NDRB is authorized to consider outstanding post-service factors in the recharacterization of a discharge, to the extent that such matters provide a basis for a more thorough understanding of the Applicant’s performance and conduct during the period of service under review. Verifiable proof of any post-service accomplishments must be provided in order for the Applicant to claim post-service conduct and behavior as a reason to upgrade a less than honorable discharge. Evidence of continuing educational pursuits, a positive employment record, documentation of community service, and certification of non-involvement with civil authorities, are examples of verifiable documents that should be provided to receive consideration for an upgrade based on post-service conduct.



The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide additional documentation to support any claims of post-service accomplishments at that time. Representation at a personal appearance hearing is recommended but not required.
